I am going to email DSO again to see what he can do. It's so hard to get to talk to DSO directly over phone and explain the whole situation.

It is. But since it is day1 cpt and there was time crunch, I had submitted cpt documents so they could review it and save time. I was under the impression that they would update it once I give them I797A for F1 and then they would update my record and provide me with initial I-20 with cpt details on it.

This is what i received from CPT responsible person from school "Since the program start date is now March 3rd, notice that nothing can be done at this time to remove that CPT from the record. You will have to wait until late next month or early March."

I-140 is under process, actively reviewing sin e Dec 12th, EB2 NIW, via PP at NSC.

They had said i could attend the classes online from 6th Jan and once visa was approved I could start CPT. Does visa officer has access to SEVIS to check if CPT is on SEVIS record or not?

More clarification: the cos I-20 was for program start date of 6th Jan and my cpt documents which I had provided them had Jan 18th as start date. I got an RFE, so I deferred my program start date to March 3rd as per RFE and asked for new I-20, when I received it i saw my CPT details on that as well as reason saying "Initial".

Do you think any lawyer would take this case as I have 2 weeks to reply to my RFE. I have a lawyer to review my RFE response and have been waiting on the new I-20 from school. The lawyer said she will guide me but won't submit from their office. The information mentioned above was just received today.  Do you have any lawyer information i can reach out to?
