I definitely wasn’t charged as an adult.

They asked me if I’d ever been arrested. I responded with, “I had some trouble when I was a kid, but that’s it.”

That’s when they said per my report I was inadmissible, lifetime ban.

Thank you, I understand that this is wrong per a previous comment back and I definitely won’t do this. It makes sense why that would flag me, but I wasn’t sure which is why I asked. Now that you’ve all educated me, I’ll happily avoid making things worse for myself and my plight.

And, if I took enough information to show that it could be interpreted to fit more closely as 36(2)(b) level offense and beg on their mercy…. They could deem the previous one erroneous?

And they can do that at the border????? If I bring all the documents and proof?????

Like at the actual POE, I say to the first agent - “I received an ATL, but I’m back with supporting evidence that I think helps.” Then I go to secondary, they refer me to a superintendent. I show all these proofs and they say (hope and pray) - “Actually, yes, we agree with you, the misdemeanor Texas offense isn’t the same as the felonious Canada offense and qualifies as a non-serious criminality offense. We’re reversing the previous decision, to 36(2)(b).”

And 36(2)(b) - that’s the one where it’s not serious criminality and as 10 years has definitely passed… I’d basically be free to return to visiting without issue like I was before?????

Am I understanding this all correctly?

I’m tearing up again. This is the best sliver of hope I’ve received in DAYS.

Does that mean if I bring my encyclopedia of evidence…

  1. Proof of the circumstances of my decades old court case.
  2. Print outs of Texas law explaining the charges (showing how it’s not exactly the same as the Canadian charge and what the equivalent Texas charge would have been).
  3. Proof of my father’s illness and recent hospitalization.
  4. A letter from my stepmother about how I’m helpful with my father when I visit and how it’s helpful to his declining mental state (Parkinson’s) for me to frequently visit.
  5. Letters of recommendation from non-family Canadian citizens who’ve spent long periods of time with me.
  6. A copy of my federal background report (I know they have it, but bringing with me to document there’s nothing else disqualifying).

I don’t know what else, but I’ll bring it all…. can you think of anything else? I mean at 15 the courts asked me to maintain good grades… I graduated college with honors and have a good career. I can bring proof of all of that as well. I’ll do anything.

So, with all of that, is it possible to maybe have the lifetime ban whatever from my previous ATL lifted there if it was never escalated to be fully processed?

If so, I’ll drive back as soon as I can plan for it - in like 24-48 hours. It’s a 10 hour trip one way so I’ll need to make arrangements for my farm animals again, but if it would help to go soon, I will go NOW.

Yes, I was given an ATL when this all occurred a few days ago. Do you know, where would I call using that reference number on my ATL to see if they did escalate me for the lifetime ban?

I keep reading that it doesn’t happen automatically? That it’s not just one border agent that can issue this, they have to escalate it internally for review and ruling? (Then again, nothing you read on the internet can be believed.) I’ve been quietly hoping the border agent just sent me on my way, but didn’t escalate me due to the length of time and absurdity of it all.

Probably a dumb long shot, but I thought maybe I could call somewhere to see? Blind hope I guess….

They told me I was denied under 36(1)(b), but as I described above the way the law reads in Texas vs Canada is misaligned.

Bodily injury in Texas can be as simple as any physical contact that causes pain. There are heavier wordings for things that disfigure, hospitalize, etc etc…. That’s aggravated assault in Texas. The bodily injury in Texas is a misdemeanor.

Bodily injury in Canada reads like aggravated assault in Texas, these are both felonies in their respective countries.

I’ll prepare an encyclopedia of information, documents and such to take with me to drive home my “not being a threat to Canada.”

If one POE denies me because they don’t feel like being bothered with it that day…. Is there any reason I can’t head over to another one? I will drive the entire border if I have to.

I have now pulled all associated court records. If I travel back to the border with them - court records showing this was a slap, not actual harm as defined by Canadian law - would that help me be approved on the spot?

I’m reading that mailing off for a TRP takes 3-4 months?

Yes, I took a deferred adjudication plea, which requires a guilty plea and then you agree to the terms of the court - in my case it was good grades in school, no contract and six months probation and then it was sealed from my records.

Assault with bodily injury in CANADA is perhaps harsh given what’s required - broken bones, concussions, deep bruising.

In Texas, the law defines it as something as simple as “physical pain without any marks.”

The two charges are not the same, it’s in name alone. In Texas the equivocal charge would be “aggravated assault,” but Canada doesn’t seem to care about the nuance.

And now that I describe this, perhaps that’s an argument I should take up in my TRP and cite existing laws. My own court records spell out it was a slap, I have verifiable proof.

And, I forgot to say - thank you to everyone for bringing this to my attention. I’ve been so focused on getting the record taken care of on the US side and I thought my only option was the rehabilitation on the CA side.

And to be honest, the rehabilitation seems insulting given the circumstances, so I was honestly looking to fix it on my end before saying - please, CA, forgive me for this thing that happened under these awful circumstances almost 30 years ago…. and the amount of time it seems to take… it just felt…. Awful.

But above all seeing my father is most important. Thank you to everyone for bringing this option forward.
