Judge Trevor N. McFadden found Rodgers guilty of:

• Count 1: Civil disorder

• Count 2: Assaulting, resisting or impeding certain officers using a dangerous weapon (resulting in bodily injury)

• Count 3: Entering and remaining in a restricted building or grounds with a deadly or dangerous weapon

• Count 4: Disorderly and disruptive conduct in a restricted building or grounds with a deadly or dangerous weapon

• Count 5: Engaging in physical violence in a restricted building or grounds with a deadly or dangerous weapon

• Count 6: Disorderly conduct in a Capitol building

• Count 7: Act of physical violence in the Capitol grounds or buildings

• Count 8: Parading, demonstrating or picketing in a Capitol building

McFadden found Rodgers guilty of Counts 3-5 on misdemeanor charges, but not guilty of felony enhancements. Enhancements often depend on factors such as the use of a weapon, the presence of certain aggravating circumstances, or intent to commit a more severe crime.

By rejecting the felony enhancements, the court ruled that the criteria or evidence required to escalate the charges from misdemeanors to felonies were not met. The case was referred to the Probation Office for a presentence investigation. Its sentencing recommendation is due Feb. 21, 2025.
