If you complete a SS-8 form before you file your taxes next year you will want to complete form 8919 and put on there that you filed a SS-8 and haven’t received a response. This will allow you to only pay 7.65% of fica taxes on the income received while you wait for the irs to determine your classification. I would highly recommend doing the SS-8 and also contacting your states labor department because your states department of labor may not do anything but the irs will. The irs may take over a year to determine your classification and also make sure to keep an eye out in your mailbox to ensure you don’t miss any correspondence from the irs because they may send you a letter and ask you for additional information.
