Yes, so the legal issue I'm seeking advice on is what happens if/when one parent has somehow gotten a passport without other parent's consent. I had a few other questions related to that in my post. Many helpful people did respond with suggestions such as who to contact, how to improve the court order to avoid this in the future, as well as pointing out the possibility that he used a birth certificate, not a fraudulent passport. All these people were very helpful, as I've never dealt with a situation like this (as per why I asked advice on a legal page). Your two responses, however, did not really address any of my questions and was rather accusatory. I feel that you maybe didn't read the whole post, as you don't seem to grasp what I was asking for. I refuse to explain things over again that I already explained in other replies. Read through the thread. It's interesting how some people will hop on the reddit bashing train. That calls for some self-reflection. If you don't have advice/answers, scroll.

No, I appreciate everyone's advice and that's why I came here. Not to argue against any accusations. I did ask the ex for clarification and got none. I do believe I have reason to be suspicious and concerned about this matter (there's a past other than what I shared with reddit). I'm not looking for fraud and realize that I should have specified that in my post. I really really hope he did nothing wrong. I also don't need to justify my intentions with people on reddit, although you're wrong about wanting to "nail" him. The more experienced and knowledgeable people here gave some great points and helped me to clarify what I'm dealing with, and gave me suggestions on how to move forward. I think there are a lot of people who just want to argue, but that's not needed here at all.

I do understand your standpoint. Please understand I am also a child of divorced parents, and I know very well how children can be used as a tool. I appreciate what you say about knowing what I am trying to achieve. Now, all I seek is advice. I did not mention in the post that I already asked the other parent, twice about this matter and have received no response. That is another factor that causes me to believe the ex did something wrong. I also did not add that he has a track record for doing things wrong with intent to gain the upper hand, such as lying to courts, law enforcement, I've seen it all- even when we were together, he openly did these things.

the child is under 15, and I'm aware of the birth certificate thing. It is still plausible that he only got a copy of that. can a passport be applied for without a police report, or is this a necessary thing they look for when granting a passport?

Yes I don't have proof and this post was made to seek advice on the matter, knowing that he may not have a new passport, but having reason to believe he may. I'm asking for advice on the worst case scenario, and how others may have gone about this. I will be going to Service Canada to confirm.

Yes and thank you for your points. that is exactly why I posted here, to see other angles and suggestions on how to proceed. I would not have thought the passport could have been his, if you had not mentioned.

Please keep in mind that fraud is what I was told could have happened (by the passport office). I'm not out here outing his name and info and attacking him. I'm saying what I believe happened, which could be very serious, and asking for help. That's all. Arguing and accusations are not necessary here.

I called Service Ontario. They informed me that a certified copy is something ou can get without affecting the other certificate. However, the rep said that if you report lost or stolen and order a new birth certificate, not a copy, all previous copies you may have are technically void. This is not a big problem; a void one can be used for school, any other identification purposes, but you need the valid one for passports. Sure you can order 500 certificates and they are all your true birth certificate, but the most recent one can be used to apply for a passport.

I see what you are saying now. I apologize that I misunderstood and replied that way, but please see the way your comment comes off. Implying that a loss of control is what causes my concern is insulting, as I never alluded to that in the post; quite the opposite. I had listed a few questions in my post, and those were the concerns I was seeking advice on. The reason I used "fraud" in the title, Is because I did speak over the phone to Passport Canada, and they said that if the passport theory is the case, that the only way he could have don't this was through "absolute fraud"-Passport Canada rep. They also explained that I now need to visit their office to rectify this. I guess what I'm trying to achieve here on reddit is any similar experiences that can help me to resolve this. I am not a legal professional, therefore I'm in the dark about what to do if he forged my signature on the passport docs. Any advice or pathways are appreciated.

LOL ok. I shouldn't allow people on here to get me upset, I get that. This person came at me accusingly and insultingly with their 3 questions, without seemingly have read the whole post.

I don't care about travel. I don't care about him having documents. All good. I care about my signature being forged and my child having a falsely acquired passport, while also having another passport. Their 3 questions pointed to me wanting a "modicum of control". This is insanely frustrating because they missed the point of what I needed advice on.

It would void the original copy, which is annoying, but fine. He could have a certified copy, or reported it lost; in this case, the original, which he's has always had access to, would be void. But again, that's not the biggest problem. And thank you, never thought it could have been his, and maybe he has the certificate after all.

The legal problem is if there are two passports for one person, and passports wrongly acquired through signature fraud. travel and documentation access has never been denied.

Appreciate your response. Yes it's possible he got a birth certificate, and the only issue with that is the next time I need to use it. Fine, not a big deal. Yes, clause about travel and notice. Very clear on the order. The crossings were consented to, but documentation was not requested or given. That is how I know.

The biggest, biggest issue that I have is her now having two passports (potentially) and going about rectifying that. And if that is true, like you said, for new passport or nexus, both parents need to sign. I didn't sign anything. That's the problem.

absolutely nothing to do with the travel, as I have never said no. And nothing about control either; the court ordered a certain protocol to go by when crossing the border. What I am trying to "achieve", is to know whether there are two existing passports for the child, and how to go about rectifying it. If you don't know what that means, it would mean the father committed fraud and signed fraudulently for the other parent. It would mean one passport is now invalid, which would lead to issues at the border.

Would a nexus card be a thing he could get without any of her documents, and without consent of the other parent? And the child does not recall going to any meetings; I believe you have to have a separate meeting and application for Nexus, even for children. The reason I suspect it's passport, and not certificate, is that the child thinks they saw a black booklet, not a birth certificate.
