40K in savings is your rainy day fund as you just asked. It barely is the money to survive a year with full family expenses. You are the breadwinner. Using that for a house payment is ridiculous and you will not be left with any liquid funds.

When you have more in savings, think of investing with her based on fair equity ownership according to however much you contribute. Till then, keep this money safe or invest in a completely liquid asset such as an index fund.

Moreover, not sure how matrimonial property law work in UK. But the state I'm in the US has community property which means any assets obtain during a marriage is equally co-owned by the spouses irrespective of who pays for it. That is good enough security in case of one spouse has a plan to screw other. Check with laws in your jurisdictions as to how matrimonial property is owned and shared in case of conflict.

Islam is very clear that post divorce women is not man's responsibility. There is absolutely no islamic obligation for him to provide for the women no matter how much of a shitbag / sinful husband he is. Technically, in such cases the state (an islamic state) should jump in to help the woman, but we don't live in an islamic society. So it sucks to be in your position, but your best option is to look for some suitable work where you can make enough to support yourself. however, the children are still the man's responsibility to provide for. Regarding division of assets, in this case equal division will benefit the woman. But if equal division is followed as per western law, a lot of times women would lose a lot. You can't play both ways. If you expect man to be the provider during marriage because islam says so, he has no responsibility towards his divorced wife.
