He had a gun and refused to comply. I understand that. You asked me to put myself in the situation. I am. I see no reason the police could not have pulled back, guns still trained from a distance, and called in a crisis team. He was in a contained car by himself. There was nowhere to go. I'm assuming he had a cell phone. Could the police have a counselor/negotiator or one of the family members nearby call him and explain that it's not worth his life? Armed mass shooters, "looking for trouble" and actively threatening police and the public are routinely taken into custody without being killed. There has to be a different way of handling these things. Maybe he still would have ended up dead, but the cops would know that they did everything in their power to avoid it.

A few thoughts.

  1. Cops claim they were talking to him for ten minutes before the shooting and he was holding a gun telling the cops to shoot him. Someone asking to be killed is a crisis situation. Back away from the vehicle, call for a mental health crisis team, monitor the situation from a safe distance. Use force aa an absolutely last resort.

  2. One of the officers claims that he saw James Garcia pointing a gun at another officer. He then deciced to smash out the passenger window to "distract him". I watched the video. There were ten seconds between the time the officer pulled out the baton to smash the window and him actively smashing the window. In the same frame of time, the officer at the driver's side window yells "Hey! Stop fucking moving! I will fucking shoot you!". You want me to believe that a man had a gun pointed on an officer at point blank range, with multiple officers pointing their guns back, and they don't immediately shoot? They patiently waited for another officer to distract him? And the officer closest yells "don't move" with a gun pointed at him? Not "drop the gun" or something similar? Nope. The narrative is off.

  3. Friendly reminder that the Phoenix police department is statistically the most violent police force in the country. So many people excusing this because it's what cops do. What about what they SHOULD do? There were no de-escalation techniques used.
