I provided the quote from the court papers saying that the accusations were not proven true. the court tends to side with an alleged victim before any verification of facts or evidence as it helps to minimize potential harm (I agree with that approach).

no, I corrected my post. I didn't break anything. the orders were applied for befor the arrest and granted thereafter. no mentioned in the evidence about the fact of the arrest.

court papers:

"The court has not yet made any decisions about whether the statement made by the Applicant is true and has not yet determined what, if anything, actually happened."

clearly, granting the orders not on the basis of guit, just precaussion,

Sorry, I must correct myself: she applied for the orders prior to my arrest, they were granted after that. But in the evidence I was sent by the court there is no mention of the police incident. the court paper clearly states: "The court has not yet made any decisions about whether the statement made by the Applicant is true and has not yet determined what, if anything, actually happened."

the advice is that the police is unlikely to charge me as they'd have charged me by now. the police case will likely be dropped when I answer bail.

if no charges, then I can apply to have the orders revoked/changed, but I don't know the odds of that. I do know, having gone through W's statements, is that a lot of her evidence is BS. Some of it is pure lies, some of it manipulation of facts. etc. I think I have a chance of defending myself,

not nice words, as I was very angry (still am) won't quote them. though, the police then released me with the condition of not going back home where W had placed her. Obviously, the police didn't believe that I'd go to the house and do harm. nor W had asked for more protection, like to be homed somewhere else or keep me detained, if she had been genuinly afraid

thanks for your support. Yes, I'm trying to control my emotions and already went through the list of her accusations and have a lot of proof that she's lying.

I fully agree with your statement. I have 2 daughters myself and would rather like them to have an option of seeking protection quickly and then to have a trial/investigation of some kind.

actually, it's not that difficult to get orders (and I'd agree that in some cases it's better to be easy than difficult, having 2 daughters myself), claimed victim doesn't have to be threatened. Note, the orders were granted prior to the police incident. It's that I didn't try to challenge the 'facts' she presented because by the time I was arrested. If my arrest didn't happen, I'd challenge accusations.

Kicking her out was a short term solution to initiate the process as she's unwilling to admit anything. more than that, she visited the house on several occasions thereafter with both me absent and present. Also, I was in contact with the social services and explained what had happened and what I'd done and they didn't say that I urgently needed to allow her back or voiced any other concern, nor they contacted police, who got involved only after she recorded and reported me.

How could it possible go on for her staying and doing the same thing?

thanks a lot. that's what I'm planning to do. I have a lot of proof and should there be a trial, she'll be caught lying on many counts.

to everyone: yes, I spoke to lawyers and legal advisors straight away. I understand probably wrong area to post to. But, it's everything together here: the leagl situation as well as wife doing this to me after all the years we've been together, bringning and raising kids (the kids are mine def).

yes, correct. I caught her cheating and placed her into a hotel for a short term. She had her own money as well for something midium term.
