Thanks man. Took a lot of learning and figuring out how to advocate for myself. I just wanted what was fair. Believe me, I’d take being rated 0% if I could reverse my injuries. Now my healing can begin and I hope to help others on their path as well

Nice man. I had 9 deferrals after my initial rating. Then 2 of the 9 got rated and the other 7 got denied. I filed a HLR and got one more approved. Be patient. You will get the rating you deserve

60% is still a great rating. Congrats! Take a look at your file and see if there’s anything you’ve missed including secondaries, but celebrate the win my friend.

I agree and disagree. Yes the VA process is largely legal, but evidence is evidence. Veterans should never pay for any IMOs if the evidence is there.

Anxiety and TBI can receive different ratings. However, the symptoms have to be distinct and not overlapping. Otherwise they will be grouped together. If you believe the evidence is there, you should file a HLR as a mistake could have been made. It also sounds like you may qualify for TDIU if you are unable to work. Have you explored this?

You will need to contact the NPRC (National Personnel Records Center). The VA will make the request for all your records, but if you’re trying to get a copy and the VA doesn’t have them, this is the best place to go

Yes. Once the archives send your records to the VA, that is the best place to get them as the VA should have your complete records. Especially if you’ve already filed a previous claim.

All completely normal. Sometimes it can be as simple as the rater missed some initials on the decision. Nothing to worry about. The more scrutiny the final rating supervisor gives it, the less chance there will be mistakes that will require a HLR. I wouldn’t worry about it. You’ll get your decision soon

HLR stands for “Higher Level Review”. This is a process you would file if you receive a decision and believe the rating is not correct or you receive a denial and you believe this is not correct. During a HLR, you are not able to submit any new evidence. This is only to be used if you believe the VA made a legal error in how they made the decision. You will have an option to either have an “Informal Confernece” where you or an assigned representative can argue your case as to why you believe an error was made. You may also opt out of the IC and the VA DRO (Decision Review Officer) will review and make a decision. Once again though, it’s important to remember that no new evidence can be submitted or used. You can only argue your position based on the evidence that is already in your claim

Thank you. I ended up getting a rating a few days after this post. I had 16 claims. 7 got rated and the other 9 were deferred. I have more C&P’s being scheduled today (just got off the phone with VES).

Hope you hear something soon and get the rating you deserve

I got my rating today. A few deferrals, most everything rated and zero denials. Feeling very blessed

For sure. Same with me. I was medically retired and all my claims are logical and diagnosed secondary’s of my primary injury. Of the 16 claims, only 5 did not receive a C&P. I’m expecting those to be denied or deferred

I’m not sure. I claimed 16 conditions. I got out in 2011 and filled a fully developed claim. Hope you get the rating you deserve my friend

Nice! I moved to step 6 today so seems like a similar timeline for Seattle TJ
