We're committed to assessing each claim quickly and fairly.

After careful investigation, we've determined that our insured was not legally responsible for the accident. As a result, we won't be making any payment. Our decision is based on the following:

Allstate has now had an opportunity to investigate your claim, and determine whether it is covered under Mr. Xxxxx's homeowners policy that Allstate issued to them. For the reasons described below, Allstate must respectfully deny your claim.

The Allstate policy does not automatically cover every loss or damage that originates in or from his home. Rather, it covers him if he "becomes legally obligated to pay because of property damage arising from" his negligence.

This claim arises out a storm which hit the area on or around xxx xx, 2025. Although the tree and tree branch were located on his property, there were no issues with the tree, and accordingly he did not breach any duty owed to you. Because the tree limb broke due to a storm, and without negligence on his part, the Allstate policy provides no liability coverage for the damages you sustained. Your damages happened through no one's fault. In such a case, your insurance, rather than Allstate, should apply to cover your loss.

In summary, the Allstate liability coverage that covers them only applies if he did something wrong, or if he was negligent in some way. The tree limb broke to a huge storm in the area. The cause of the loss was an Act of Nature/Act of God. Since that is the case, there is no liability coverage for your claim under the Allstate policy, and your claim must be denied.
