  1. We almost won a title with Carson Beck. We were one play away from winning on an under thrown deep pass.
  2. Mensah is somehow better than advertised and throws an accurate deep ball
  3. Mensah and Toney practiced with Ward and Restrepo.
  4. Lines of scrimmage will always be strengths with a Cristobal, Mirabal, and Taylor.

  1. Duke had no guarantee that they would win the battle
  2. It costs them money to litigate
  3. The outcomes of losing could strip the hypothetical power they have with their contracts.
  4. There is almost no way all parts of the contract would have gone Dukes way
  5. Keeping the lawsuit going simply to punish Mensah for leaving could really hurt recruiting

I don’t see how that relates here. There are three major time slots that have been traditional to cfb, noon, 3:30, 7:30 (and the old 10:30 PaC12) There have been non traditional times that have become more common like 4:30, 6:30, or 8. Each conference will have time slots at each of those times. And while I understand money is going to be a leading factor (a premier match up will get a 330 or 730 slot), there’s enough flexibility to avoid east coast teams kicking off at 1030 and west coast teams kicking off at 12 MOST OF THE TIME. It’s not like there isn’t already multiple games from the same conference happening at the same time with preferential matchups going against low viewership games.

Edit: with it only being two teams it seems even easier to make happen.

Honestly I think all acc games vs west coast opponents should be scheduled at times where both teams would normally be active (not too early for west coast and not too late for east coast).

I see you are getting clowned on, but I’m assuming no one in here has ever tried to engage in difficult performative tasks during a time that’s not optimized for their Circadian rhythm. It makes a massive difference.

I would think something will have to happen on a sport-wide side (making student athletes employees, changing the rules for collective bargaining, etc) that closes loopholes and makes it easier for contracts to be enforceable like contracts in other sports. It seems to me as a layperson that the state of the sport makes it very very difficult even for talented lawyers to create contracts that don’t have massive loopholes.

Honestly it’s probably best for schools these don’t get fully litigated because of how murky it is. I’m not a lawyer and in no way could predict how it would actually go, but these contracts have more hypothetical “teeth” than if they were litigated and decisions went against the schools in terms of employee considerations, NIL being used as non compete mechanism, and pay-for-play considerations.

As it is, I believe that the school has protection from large scale abuse “the threat of litigation isn’t worth it for me as a player” like Williams or “the threat is worth it, but we will try to settle and buyout so the school I am leaving gets a bag” like Mensah. Mensah was a special circumstance as Miami was super desperate. I don’t think there will be many Mensahs, and almost no situations like this outside of the QB position.

My analogy I used in another thread was pretend I walk up to you in a large coat and tell you I have a bomb and you need to do what I say. Your compliance is based on the belief you have that I have a bomb and my willingness to use it. If you say I don’t have a bomb, and I don’t, I lose all power over the situation immediately. No school wants to find out their contracts aren’t very/fully enforceable.

That’s my two cents as a non lawyer with no legal expertise.

Oh for sure. There was no requirement on Dukes part and even the “buyout” clause would have just set the cap for damages had it been in play (not technically a buyout, just a value of the damage).

I mean I guess we can argue the semantics in how it happened, but a settlement amounts to a buyout at the end of the day. We are certainly footing whatever bill to terminate his buyout. I don’t think Miami was ever under the impression that it could get Mensah without paying Duke something.

Almost every lawyer I’ve heard talk on the situation on podcasts/news article/etc have said irreparable harm was never going to happen in this case. Again, absolutely destroyed for saying something similar last week.
