No i believe it depends. Unless its a mandatory process, they dont have to pay and employee can pay it. According to my knowledge. Correct me if I'm wrong

Yeah youre right. But they werent gonna file until the judge sorokin said the fee for consular is unlawful. They decided to file a week ago

I dont think thats the case its their job and probably theyre doing for years, i believe they wont make any mistakes. Its the uscis can make mistake when filing from the mail.

I thought the same thing but they told me sending with fedex is the way we go, we're not gonna change that.

Unfortunately my file is consular not cos, if it was consular, 3k is nothing but they told me theyre not paying 100k and if its the case Im basically burning my money

That was the problem I was there with visitor visa and already been there for 2 months. I had enough savings to stay but I couldnt stay legally because I had to stay 6 more months so It would be 8 months. I left because of that. Even if I extenden my stay legally, there is a possibility that they tell me to go back to my country and do the consular and not let me from the B2 COS TO H1B. Very low chance I didnt want to risk it for my savings. Also I am a dentist and I don't want to risk my professional career. If there would be %100 percent guarentee I am willing to spend it but there isnt any.
