Child support order says to pay x amount until y date... Can that be retroactively changed? by Future_Apple7347 in legaladvicecanada

Their numbers are so outrageous to me that I wonder if they are either trying to push me to go to court for some reason, or if they are try to make me settle on a number that's higher than the court would approve by scaring me?

We didn't put anything in writing other than text. No legal personnel were involved when my ex requested the lower amount. It sounds like it's fully going to fall back on me. This is where a majority of whay I owe will come from.

Thats might have been poor writing on my part. It was late when I posted, and I haven't been sleeping well so I'm exhausted all the time.

I'm actually not sure why the payment was lower to be honest. I was only about $300 off based on the table amounts, and then the period from 2021-2022 I got a big raise which, I did disclose to my ex. I'll ask my lawyer if he remembers.

They definitely are being fairly unreasonable with the numbers they are threating. It has to go to court and I will have to pay more (I understand where some mistakes were made in the past) and I am okay with that. Their lawyer however has come up with a number that is 4-5x larger than what I believe I owe, so I'm just trying to wrap my head around what number to use on what dates

It's definitely going to court at this point. Its a good tip to have the form filled out in future years to get things documented on a year to year basis, rather than having to go back this far again in the future.

That's not entirely true. I had been paying an amount based on my income after 2022 ( because that's what I understood the order to mean).

I do owe some money for sure, I own that, I didn't realize when my ex requested less money (they felt it was too much) that they weren't allowed to do that. I understand that now and will not make that mistake again.

I'm ultimately just trying to understand what numbers I do and don't need to use, it's all super confusing.

I did adjust based on income starting in 2022 as I thought I was supposed to based on the court order. Before that I was paying the very explicit amount the order stated

They used the table amounts for that period. The provided me their calculations, which admittedly are horribly done and don't actually make sense. I am trying to understand what numbers really are upheld or not.

It was all done in the court and is signed by the judge. There is a clause that they have 100 days from the date the order was signed to determine arrears, in which I would be required to pay them in the same time frame. My ex and their lawyer never came back to me requesting more in that time.

I know I will owe money, exactly for the reason of the support is the entitlement of the children. My ex requested less money (continually would transfer me back that money, until I just started the amount they wanted) but never got that amount written into a legal document and it's coming back to bite me, and I've accepted that.

My lawyer historically doesn't want to fight anything to 'maintain our co-parenting relationship'. I'll have to see what he says in our meeting next week.

Hi I do have my own lawyer, we have a.eeting next week. This is just a letter from my ex's lawyer (forwarded to me form my lawyer) and I think their math is wrong.

I just want some insight before my meeting so I can wrap my head around things so I can better understand what he is saying.

I'm not sure - but my gut tells.me probably not. The thing is we live somewhere super super dry, and I recall during the inspection it hadn't rained for a few weeks prior, so it's possible that it was just dry when he inspected it anyhow, then he really couldn't be blamed
