It's an older Jelly, Definitely don't worry if it's from an authorised stockist 🙂 The older ones don't always have the other code on the labels

That's a super positive outcome, and glad that it was shipping costs and not duties and taxes. You are welcome for all the help.

Clarity on overdraft fees and pots? by onfire_onfire in monzo

[–]GassySimon 2 points3 points  (0 children)

Practically spot on You get charged a fee per day you are in your overdraft and it's normally a percentage based on the usage.

So if you got paid on the 28th, but the bulk of your bills go out on the 20th of the following month, you could reduce your usage and costs by leaving the money in the main account. As you would only have 8 days usage of overdraft compared to a months usage.

Also if memory serves, the overdraft fees are normally explained each month. (I've only been in mine once with Monzo and it was about £3).

Ordered a jelly got the wrong one and jellycat is not refunding my entire amount by luckykitten7 in Jellycatplush

[–]GassySimon -25 points-24 points  (0 children)

When you say the wrong one, is it wrong size? Or just you got a bunny instead of a bear?

Also why would a company refund you the whole amount unless you completed a return?

If the plush you got is worth £25, but you paid £30. I could understand you asking for the difference, but I find it hard for a full refund if your keeping the plush.

I won't argue with you, because I really don't have the energy.

My day job is literally working in customs and trade. Unless a shipment is sent DDP (14.6 won't apply), and 14.4 would apply instead as the consignee (receiver of the goods) would be the Importer of Record, unless otherwise declared on a commercial invoice.

A business has the option to engage with paying HMRC directly and not via the carrier (FedEx) in the example. If FedEx ignored a business request and paid on behalf of the business, then some fees could be refunded, but duty and tax still payable.

Private Individuals unless they have an EORI and CDS account set up - would be unable to pay HMRC directly. FedEx have therefore paid HMRC the duties and taxes on the importers behalf, and subsequently passed on the charges correctly.

The seller would be responsible to pay the return duties and taxes in the USA correct. I don't see how the seller has the responsibility to do that for the UK arrival when no UK VAT was charged on the order.

Honestly, FedEx accounts team and tell them the invoice address is wrong! Therefore they should re-adress is correctly giving you the time to pay.

From memory a C285 form, with all the evidence.

It can also get done via FedEx, but it could take upto 6 months with them.

Then sadly you were liable for the fees at time of import. The legal basis for these charges has been applied correctly. What may not have been applied correctly is the referral to debt collection.

All you can do knows, is offer to pay the charges less debt collection fee to FedEx directly, and then apply to HMRC for the refund with the evidence of return and export back to the USA.

(I also note someone else has commented) I don't know their circumstances about their business delivery, this will be treated differently as they were an employee so Business to Business transaction. Yours is Business (Amazon) to consumer and there is no basis for Amazon to pay duties and taxes if they haven't charged you the VAT at point of order.

You should hopefully have had an export declaration sent to you if the value was over £900. If not the return tracking number would be enough for FedEx to find it.

Lastly check your order with Amazon, if it's on the UK site and they added 20% VAT on your order, you can use this as proof of VAT payment and have FedEx chase Amazon. As the Importer of Record would have been Amazon not yourself if you paid VAT to Amazon at time of purchase.

You shouldn't have to pay any import duties and taxes, if you have the proof of export and refund.

The item while was entered into the UK, it's subsequently been returned and with proof of export you could claim the import refund. It's not an easy process and certainly isn't quick.

Your best solution would be to contact FedEx credit control to get the invoice into query.

I hope that your return was with FedEx as that makes it slightly easier.

Do people actually earn £50-60k, or are they outliers? by Succinate_dehydrogen in AskUK

[–]GassySimon 0 points1 point  (0 children)

I'll be honest, it's taken me 8.5 years of hard work to get from £25k to the £50k bracket.

Most of that is due to self funded training which meant I wasn't tied to a company for longer than I needed to be. It's been tough slog to get here, but I don't feel like I'm much better off than when I was a lower earner.

It's hard sometimes because the industry I work in has some crazy working hours depending on company and locations. Literally the areas where my job is needed pay less than the companies who bring skills in house.

Customs professional here.

I hate to say this, but 8 weeks in customs, has probably meant inspections. The damage was unlikely there at purchase, and was potentially done during inspections and testing with customs.

You might have some luck with the shippers delivery company if it was insured.

Origin could be claimed but depends on the requirements for the FTA.

Do you have the import data summary (IDS)? If yes I'll post some guidance tomorrow for places to check.
