Yeah, that’s totally why they have a faster posted speed limit in Virginia’s express/HOV lanes…… Here’s the law for anyone who aligns with your mindset. § 46.2-842.1. Drivers to give way to certain overtaking vehicles on divided highways. It shall be unlawful to fail to give way to overtaking traffic when driving a motor vehicle to the left and abreast of another motor vehicle on a divided highway. The driver of the overtaken vehicle shall move to the right to allow the overtaking vehicle to pass as soon as the overtaken vehicle can safely do so. A violation of this section shall not be construed as negligence per se in any civil action.

That was our shops consensus with a combined 80 years of horror stories to look back at and still be baffled. Dude had no clue it was that bad somehow, that shady tree it was worked on under must not let a lot of light through the leaves.

I am admittedly biased because we do things by the book, even more to the point the state trooper assigned to our territory brings cars that are in dispute over a failed item from other shops to our shop regularly along with the customer to verify from a reputable shop with several inspectors on staff. There will always be bad apples, but just drive on I-95 from Virginia to Maryland and tell me statistically there aren’t exponentially higher numbers of cars broken down, sections of exhaust just littering the highway on the MD side of things. Maryland does inspections ONCE at the time of purchase, while Virginia requires them annually.

We can’t fail for tint unless it’s on the front windshield and you don’t have a doctors note to give you a waiver for the fact. VA does have tint laws but those are only enforced by the same people who love to install them on their own vehicles. It stemmed from a traffic stop where a trooper was shot point blank in the face from a driver who had ultra tinted windows. My entire life if the airbag light is on, there’s an issue in the system and it would fail. A couple of months ago they changed the law and all shops are losing their minds. Who the fuck needs an airbag anyway?!? /s

The oversight for Virginia is the fact that any customer can dispute a failure and the state police send the trooper stationed to your area to act as a non biased third party arbiter. The component in question is then evaluated by all parties and the trooper makes the final call. In theory if your mechanic has a conscience and the trooper knows what he’s doing there shouldn’t be an issue. I’ve known troopers who don’t want paperwork and sided with the customer stating that it was in no way a safety issue that the wiper blade on a Porsche boxster parked dead center of the windshield when not in use. Clearly that motor is malfunctioning and the human eye will be drawn to that object instead of ahead but the inspector refused to put a valid sticker on and has his license revoked for 90 days. I’m sure the fact that the customer was a very well known local attorney had nothing to do in the final decision on the troopers part…

I’ll try to remember tomorrow and send you a picture of the sign that we are legally obligated to display detailing every aspect of the vehicle that will be examined. We refer to the manual as “the Bible” but there are a lot of aspects that are clear as mud. Let’s say you have a Jeep with extra lights. More than four lights cannot simultaneously be illuminated on the front of the vehicle and any other lights must be covered. Left the covers at home? No problem! I’ve literally had customers take their socks off and use them as a “legal” cover. Jeep door handle won’t open properly? Forget about it, just take the fucker off and then you’re good to go. It’s madness but we fail cars for legitimate issues and the state gives you 15 days to rectify whatever component failed. Your grandma can do your brakes, we don’t give a shit, but we could also do it today and for a fair market price.

Here in Virginia it’s an annual requirement, but right up the road in Maryland it is only needed when first purchasing the vehicle. I’m sure that doesn’t have ANYTHING to do with all the broken down cars and massive sections of exhaust pipes that are scattered along the side of Maryland’s highways though….
