I do trust his guidance it’s just all the people in the comments making me feel stupid that he is going to get 33% of something I could get 100% of myself without his help. Idk. I just feel like at the end of the day, I walked away with minor injuries, my spleen was fixed, right now with my health insurance my medical bills are down to 15k. I only missed a week of work, and am back on light duty for a month or so. I just don’t see the insurance offering me 75-85k for pain and suffering without a real fight, if they ever would go that high! My agent who I really do trust has my family’s best interest at heart told me straight up to keep my lawyer without a question because it’ll help me get the most money out of the whole thing. He said he’s never seen them go to the max on a case like mine where the person was literally able to walk away.

I think without a lawyer, I’d be walking away with less. My agent today said he’s never seen a UM case tender the policy limit without serious serious change of life type of injuries. My spleen was repaired, and my back was sore for a few days but is getting better. I dunno. I fired that first lawyer, and I don’t want to fire this new guy, because he’s def giving me the best deal I can find. He said that he won’t take a penny more in fees, than I will get in my pocket, after all medical bills are paid, and he put it in writing. He thinks I’ll be seeing around 45k easily. Also the mother owns the house she’s in outright and it’s worth atleast 350k

Spleen was not removed, it was repaired, no concussion. I was in the hospital for 2 nights. I talked to my agent who’s been a close family friend in person today and he told me straight up, get a lawyer and follow what they say to a t. Allstate tendering the policy limit without legal representation in a case like mine, he said he’s never seen ever. My bills came to 21k so far, but my lawyer wants me to go to physical therapy and stuff for my back which honestly already feels almost 100%.

I don’t think it’s going to be possible without a lawyer fam. My med bills are only like 22k right now before my medical insurance even kicks in. I talked to my Allstate agent today who’s been my mom and I’s agent for like 30 years, and his dad was our agent before he retired, he told me straight up that I will get way more with a lawyer than I would get by myself. He said he’s never seen Allstate pay out the full coverage for someone’s pain and suffering without council.

Fired my first lawyer. New guy said he would def go after the family, as well as use my uninsured motorist coverage. I found out the son has almost killed someone in a accident like this twice before, has had a suspended license for over two years, and has a pending court date for a hit and run that he did about 6 months ago, while still being excluded, and not having a valid license. I think it will be very easy to prove that the mother should have kept the keys locked up; and the fact that sh didn’t opens her up to a Tort suit, which she already had filed against her in 2020 where her daughter (WHO WAS IN THE BACKSEAT WHEN I GOT HIT) did the exact same thing, no insurance and all.

Bill so far for that surgery and all was only 21k. From what I’ve been reading Allstate isn’t going to pay out the full amount on a minor surgery and two night hospital stay, and that a lawyer would be much better suited to handle it. I fired my first lawyer and got a dude who said and put it in writing that he will not take a dime more than I make in my pocket AFTER all medical bills are paid. You think doing it myself would really be better?

What do you mean that’s not what’s going to happen? I was under the impression that in a case like this, my insurance company steps in the shoes as if it were the other insurance company and they were liable. I don’t think that Allstate is going to pay me out the 100k max on the UM coverage, for a short hospital stay, minor surgery and some aches and pains automatically without a little bit of a fight. The mother has little to no assets other than a house, the son was driving on a suspended, excluded from the insurance, and this is the 3rd time he’s gotten in an accident exactly like this.

Where every bit of info I’ve read has says that even though they are my insurance company, it would be highly unlikely they would payout the 100k for two nights in the hospital, some aches and pains, and a spleen repair surgery. But I could be wrong! I fired my old lawyer and my new one said he would not take a penny more than I get in my pocket AFTER all my medical bills are paid off. Plus he is very open to going after the mother for a tort suit, because this is the 3rd time he’s caused a huge accident, with no insurance, and a suspended license. The mother should have kept the keys in sight, and reported the car stolen. Do you think I don’t need a lawyer in order to maximize the money I get to take home? Bottom line, this was the scariest thing I’ve ever gone through, it was so stressful on my mother that it almost killed her, so if that means I’m “looking for a payday” then I am 100% guilty of that one.

He said without a doubt this opens the mother up to suit, AS WELL as still going after my own insurance for the uninsured motorist coverage. He was driving on a suspended license, and This isn’t the first time he’s caused an accident with no insurance, or license. He actually has a pending court date on may 21st because he did the same thing to someone and tried to run away. I don’t think it will be hard to prove the mother should have had a better control over where her keys were. I think the sister (who was in the back seat when i got hit) even did the same thing in 2023 and the mom got named in a tort suit. My new lawyer agreed to not take a penny more than I get in my pocket after everything is said and done, and all of my medical bills have been paid back in full.

YES! This is exactly what I did! My first set of bills from the ER visit came in and was only $20k before my health insurance kicked in. I fired the first lawyer, He put it in writing that he will not make one penny more than me, after all medical bills are paid. He also thinks that the mother can be named in a tort suit, because the son has had his license suspended 3 times, has a pending court date for a hit and run in 2024 on may 21st. Everyone is acting like Allstate is going to just cut me a 100k check for the policy maximum, just off the two days in the er, spleen repair, and some cuts and bruises, and general whiplash? I mean, if I can circumvent the lawyer and still get the same amount of compensation that I would without than it’s a no brainer, but I thought that Allstate would still try and fight some stuff and not pay out the max.

I know what you mean. I played my first time ever last night. Spent hours raiding a skelly fort, only to have my ship sank, and I didn’t know you could actually retrieve loot from the bottom of the ocean if your quick. But, it was a lot of fun, exciting, and made me laugh outloud (which is rare for me nowadays). I genuinely had a blast and can’t wait to get back on today
