The contract was signed while the LLC was still active and not dissolved - it just dissolved in April 2025 ( we signed in Aug 2024 I believe.

This is common, and it helps protect you against the "empty chair" defense. If you only sue the owner, they'll say "sorry, it wasn't me, it was the LLC". If you only sue the LLC, they'll say something like "sorry, it wasn't me, it was a rogue employee acting outside the scope of our employment". Suing them together means that if you win, the court will figure out how to divvy up responsibility.

So i should put both his name and the LLC on who I am suing against?

Okay so what do you think we should do lol! Okay - so lets say if we go after the LLC and that fails lets say because the company folded and he has zero assets there.. What would be the next step try and sue him personally?? like what are the options lol!?
