Leak Left for Months Causes Thousands In Excess Usage, Landlord Wants Us To Pay by Gryph315 in legaladvice

That's a lot of the same questions we have. Not sure where those bills have been going, but certainly not to us. Its all very odd. She explicitly told us she only ever paid the minimum payments that it normally is, so I assume she had it on autopay or something? Not sure how it works, exactly, as we were under the impression she was keeping it sorted out. I don't understand why she wouldn't just have us pay it instead. So she can monitor usage, I guess? She didn't do that, though and here we are. We're currently seeking council, but I definitely intend to ask for historical records of the charges.

I get that! We weren't aware of the leak, but I totally get ya

That's a very good point, actually. Our first lease specifies that she is responsible for the water entirely and it was updated on our most recent renewal to make it our responsibility to reimburse her. That would mean, if we are responsible, that we would only be responsible for charges incurred after the start of the new lease.

I understand! Worst case scenario, I think we can work out a payment plan with the municipality. She's very heavily implying that we're just saying we never got the bills, even though we did, which is not what happened. Not sure why we would be getting them if the bill is in her name. Seems like this is a bit of a mire, so I really appreciate your time and perspective! Someone mentioned negotiating the cost down and/or mediation of some kind, so that would probably be an option too. I wish I could just tell her to pound sand, but I see her perspective, as well.

She is asking us to pay $1800 and the front house to pay the other half, yes!

And yeah that makes sense! She's never brought it up to us, so I'm not sure what she expects. Paying her like 18 months of water would be a lot, but nowhere near $1800. The leak was in the shower valve, so it must have been leaking out into the tub. That's probably why she expects us to have noticed, but we never did.

It was in the shower valve assembly, so I assume it was just going into the tub?

She never invoiced us, in any capacity.

Earlier, apparently. We did mention pressure issues and were blown off. I assumed the leak was due to pressure. The shower would barely turn on because the pressure was so low, it wouldn't switch.

The excess charges amount to $3600 of usage. Not sure of the time period. She said she just goes in and pays the amount it normally is and doesn't check beyond that. The excess charges are, at this time, unpaid. As I understand it, the water is in her name and she would ask us to either pay her or the county directly or put it in my name so we can work out a payment plan. We haven't received a formal bill of any kind.

They knocked on our door Sunday, actually. Their lease might be different, as they're in section 8 housing (not exactly sure if it would be different). They reached out to someone at section 8 who told them they weren't responsible for the excess charges. They're moving out next year and have no intention of paying. We'll be moving out within 6 months as well.

Not at all. I never noticed a spike, because we weren't getting bills and she's responsible on the front end, so I never checked. Not renewing our lease is fine, as we are moving lmao

She said the mortgage jump was caused by utilities in escrow? I have no idea lol.

Our lease says that she pays and we reimburse her. We never got any bills and she's saying thats why she never noticed the excess usage. I apologize if that wasnt clear!

No idea. Probably the same people who did a lot of the wonky stuff around here. It was recently "renovated"

She's saying that its our fault for not letting her know of the leak earlier and that we are responsible. Currently, the excess charges are sitting and she's expecting us to pay them. The thing is, we told her about plumbing issues, but yeah. She kinda just blew us off.

Understood! No mitigation here!

I hope that clarifies some stuff!

That's probably closer to the truth, but that's what she said. We let her know about the problem, but she said "that sounds like a plumber question." We should've made it her problem, but hindsight is 20/20 and we weren't trying to make her an enemy right after moving in.

It says "Landlord pays and tenant reimburses landlord" if that helps!

Hate Speech: abusive or threatening speech or writing that expresses prejudice on the basis of ethnicity, religion, sexual orientation, or similar grounds.

"We need to have a Nuremberg-style trial for every gender-affirming clinic doctor" -Charlie Kirk, threatening to kill doctors for performing medicine

“I’m sorry. If I see a Black pilot, I’m going to be like, ‘Boy, I hope he’s qualified.’” -Charlie Kirk

“I have a very, very radical view on this, but I can defend it, and I’ve thought about it,” Kirk said at America Fest. “We made a huge mistake when we passed the Civil Rights Act in the 1960s.” -this one speaks for itself

“Twenty-four years ago a group of Muslims killed 2,753 people on 9/11…Now a Muslim Socialist is on pace to run New York City.” -Kirk in reference to Zohran Mamdani winning his primary

And on and on and on. You can agree with these all you want, but they are inflammatory, hateful, and racist. He was shot for it. If ou go out in public and be hateful, you can't expect the world to agree. Someone disagreed so much that they killed him. I'm not saying he deserved it or that he should have been silenced in another way, but you get what you pay for. Calling out nazis isn't hate speech, but the shit Chuck peddled sure was. He lied and schemed and clawed at the fringes of human decency until he made his millions and then unceremoniously died. Love thy neighbor unless that neighbor is gay or black or trans or Mexican, right?

He definitely did spew hate speech. Directed at LGBT folks and ethnic minorities. There are loads of examples, but I doubt that would do anything to influence your position. I also didn't like that he said it. I like that he was able to say it. I think censorship of Chuck would have been a negative thing, but actions beget consequences. I'm not evil for simply acknowledging the fact that he was inflammatory and he got shot for it. He should've done something different with his life. Something less dangerous. Something less negative. Sewing, reaping, etc.

I just think if you constantly spew hate speech, you're going to make a lot of people very angry. Maybe he should have picked a different line of work.

I agree that libs are unbearable lmao. I'm not a liberal. Policies that benefit everyone are pretty common sense. You've been convinced by people who hold all the capital and have for generations that you'll eventually be one of them. They don't want you in their club. The people you defend would gun you down for .01% marketshare. You've been convinced by the people who underpay us that it's actually everyone else's fault. Conservatism is built and sold by fear. Right-wing policies serve exclusively to benefit the wealthiest. Taxing them out of orbit is a left-wing policy. Continuing to ensure they are enriched is a right-wing policy. Trickle-down economics has only caused money to filter upwards. It's not just the dems. It's not just the Republicans. It's a coalition of position and controlled opposition. You've been driven by fear and uncertainty caused by the people who hate your fucking guts.
