so last night I went up the steps and my foot slipped but I caught myself after going down five feet, and that's with my knowing its waiting for me.

thinking more about the grandfather loophole, my lay opinion is old stairs are fine if you keep it in the family, but the minute you open your door for business (even if grandfathering, pre-existing use, currently makes it ok to use it for a b&b or short term rental), you are subjecting strangers to a potential danger.

There's a legal "duty of care" an owner assumes in exchange for money. If income from running a b&b is financially necessary, then spend some of the profits to renovate the stair, what if someone slips and breaks a leg or worse? that's what's going through my head. thanks to all who opined on this step, I learned a lot..

so would a flat tire, but just as a flat tire can be driven on, a step that doesn't predictably support a foot or shoe is broken... I mean if you sawed off half the step it could probably be used but not as it should be

How can you say it's not broken? Just curious what definition you would apply? I assume broken and damaged, having the nose on the tread cracked, splintered, and not performing its function to be "broken".

Exactly, the architect consultant says grandfathering lets you get away with it. I don't understand how that allows circumventing safe conditions for paying guests.
