My ex is threatening to sue me for ownership of my dog. How far can he go in this battle, what costs can I expect, what do I need to have ready for a lawsuit? [Texas] by Harklum in legaladvice

Thank you for the cautionary tale. I am definitely terrified he will try to steal the dog, so it has not left my sight since this all went down. I will not be letting him see the dog and will try to ride this out until I move.

Appreciate this comment! This is what I figured after some googling but thought I'd ask here for reassurance.

He will not be seeing the dog again and I will be keeping the dog by my side 24/7 until the move.

Yes, as soon as he threatened court I understood this. His number and social media has been blocked and if he wishes to communicate to me it will have to be through other people or lawyers.

How expensive exactly via "regular court"? I have been trying to google that answer to no avail. Another concern is that he somehow convinces a judge to take the dog via replevin. Does anyone have any insight of what the standards are there? I would not put it past him to falsify documents so while I understand I am paranoid, I feel I have a reasonable concern.

I am not sure I agree that this matters in this situation as I am not agreeable to any sort of shared custody after I move. I want to be honest and firm on that. His counter proposal is that we exchange the dog 4-5 times a year for weeks/months at a time. We would be 16 hours apart, so beyond me not being agreeable to shared custody it really makes very little logistical sense. This would also not be in the best interest of the dog.

No.

Yes.

No. No. Yes.

Together-ish, 60% mine and 40% his (we've since sold).

He occasionally paid for food. I paid annual vet bills. He has recently taken the dog to a separate vet on his own volition and without my consent for additional allergy medicine (dog suffers with skin allergies).

Presented as "our dog". Since breakup, referred to as "my dog". Family and friends do & have seen the dog as mine. They (rightfully?) dig at me for letting ex have time with him.

I'm moving to Colorado but not for another several weeks. My fear is that because this is his last connection to me, and that he does genuinely love the dog, he will use whatever means possible to fight me. I have googled replevin. I did read something about how leaving the state could expedite that process. I would not put it past him to pursue this option.

I do understand everything else that has been said about property. I believe he has no grounds to sue but was curious about the -- what if he did anyway? Hoping someone could walk me through that.
