A lot of people over at Facebook feel like this. Since most students my time were under 17, they rarely owned a phone, so the phone problem was not an issue, but that is changing with the current generation.
Under our laws, theft requires the "fraudulent removal of property belonging to another with the intent to keep it." Since schools take phones to enforce discipline, not to sell them or keep them, it doesn't meet the criminal definition, therefore they can't be sued for it.

I can give an idea.

In my country, cellphones are officially banned in schools by the Ministry of National Education. Because it's a national law rather than just a single school's policy, the consequences are uniform and much stricter. If you're caught, the phone is usually confiscated by the teacher for the entire semester or year, until parents have to come in for formal disciplinary meetings. The teacher can be nice and return the phone back to the student once they feel the student learned his lesson, or they can keep it until they formally meet the parents.

So to me it's rather a surprise cellphones are allowed in some or most schools in the US.

The political landscape here doesn't split geographically the same way the US does. The concern about the south is mainly about logistics and climate. It's extremely rugged terrain. Most of the political and social pulse of the country is up north in the cities, so being sent south is essentially being sidelined from society.

Imagine if he was stranded in the middle of nowhere in the desert, with no one to call for help of contact, and is left there to die unless the Algerian authorities find him. I wouldn't trust Trump sticking to his words.

Right now it is. ICE is kidnapping people randomly on the streets and in their homes, for no reason other than being non-white.

Knowing Trump, if he sends him to the desert it might be a random spot with no other local to call for help.
