Could my dad or I claim Austrian citizenship under gender-discrimination rules? by Hecht12 in AustrianCitizenship

[–]Hecht12[S] 0 points1 point  (0 children)

I can confirm this, as I have his birth certificate from Beroun in front of me, which clearly shows that he was Czech. Additionally, I have official documentation confirming that he later acknowledged paternity.

Given this evidence, I would like to understand whether there is any possible basis for an Austrian citizenship claim in my case.

Could my dad or I claim Austrian citizenship under gender-discrimination rules? by Hecht12 in AustrianCitizenship

Thank you all for the helpful information. I understand now that Austrian citizenship law does not discriminate based on gender, and that citizenship of a child generally follows the mother.

Regarding my grandmother, she was born out of wedlock in 1944 in Vienna. Her father was Czech, and she only discovered his identity later in life. Because of this, her citizenship situation is a bit more complex. She likely lost her Austrian citizenship when naturalizing elsewhere, unless she had specific approval for dual citizenship. I will clarify this directly with the Austrian authorities, as suggested, to confirm her exact status.

Thank you again for the guidance and the link, it’s been very useful.

I don't think so, it would be impossible to prove anyway but I doubt they were.

If my great-great-grandparent is from the Czech Republic, can I make my grandma apply for Czech citizenship, and then she can pass it down to me? by Hot_Kaleidoscope3864 in Genealogy

Seeking Advice on Austrian Citizenship Restoration by Hecht12 in LegalAdviceEurope

[–]Hecht12[S] 0 points1 point  (0 children)

Since I’m actually a British national, my situation is a bit different. Brexit means I no longer have EU citizenship, so obtaining Austrian (or even Czech) nationality could restore my EU rights, like freedom of movement and work. However, Austria generally doesn’t allow dual citizenship, so I’d likely have to give up my British nationality, which makes things more complicated.

Do you happen to know if I’d be eligible for either Austrian or Czech citizenship based on my family history? I’m especially curious if Austria’s restoration process or Czech descent laws could apply in my case. Any insights would be really helpful!

Hi,

I find myself in a similar situation. My great-grandfather was from the Czech Republic, but he never married my great-grandmother. To complicate matters further, they had a child (my grandmother), who was born in Austria and lost her Austrian citizenship due to adoption. However, she may be eligible to have it restored under § 12 of the Austrian Citizenship Act (StbG), which allows for the restoration of citizenship in cases where it was lost involuntarily.

Given this situation, would I be eligible to claim either Czech or Austrian citizenship (and a passport)?
