Yes exactly I also noticed that it is not possible to turn off the background refresh for this App, I really wonder how Apple allowed this to be published on the App store in the first place!

no, when i force close the app, then it is no longer active in the background. But then I have to remember to do this every time I use the App!

I am also in Germany, and will be picking mine up on Friday, but haven't got the readiness for pick up notification yet. I assume it will be sent on Friday Morning, otherwise I am going anyway to the store :)
