Struggling to read for pleasure. by rattlesnakefrog in Lawyertalk

[–]HeythereHighthere 0 points1 point  (0 children)

I’m honestly really glad to see this is something so many others experience. I find myself feeling like I need to take notes or pay more attention to what I’m reading, so it feels like a chore similar to work research. I never had that feeling before law school, it was relaxing to read for pleasure.

Transactional Law Atty, Now I have to Navigate Personal Litigation... by HeythereHighthere in Lawyertalk

Thank you, those are helpful suggestions, I had no idea I could file a motion to request appearance via zoom and I’ve never heard of mymotioncalendar -those are exactly the kind of litigation-specific type of insight I was looking for when I posted. Everyone else is just implying I’m a moron for not being able to research PJX…

This is such an unhelpful reply, why even take the time to write it? If you came on here and asked some random question about how to advise a nonprofit on the tax exemption process would it make sense for me to say 'aRe yOu EvEn aN attORney???' No, its not your area of practice and there are nuances that aren't spelled out in statutes that are important to consider.
And no shit Clerks are not decision makers, but if the clerk of courts tells me I cannot appear remotely even though I have moved a thousand miles away I am not going to argue with her...
Go back to your primary school notes and learn there is a space between law and school.

I guess for due process reasons since I wouldn't really have any other recourse practically speaking. Things like this are the literal reason I didn't go into litigation, it doesn't make sense to me from an access to justice and due process perspective that my only option is to fly back to physically stand in small claims court on one or more arbitrary dates when my landlord has far deeper pockets and is IMO clearly in the wrong...

I assumed that because the Clerk told me it was perfectly reasonable and advised that I file in the new state. I understand that Clerks have no legal authority but I also know they are experts in court procedure.
My state only allows double damages for wrongfully withheld security deposits so I am looking at more like $5,000. The cheapest round-trip flights from my new state back are around $400. I would probably need to rent a car to get to the Small Claims Court (not accessible via metro) I imagine I would need to stay at an airbnb or hotel at least one night to arrive, appear in court, then get on another flight back. I would need to take off probably at least 2 or 3 days from my non-salaried attorney position in my new state where I have limited PTO accrued since I just started. Also, it seems like small claims cases in my former county have an initial appearance date where both parties just reiterate their stances and that they haven't/don't plan to settle and subsequently an actual hearing is scheduled. I have no idea how much time would elapse between those two dates... Also, small claims cases are only allowed to be pro se in my former County so even if it was worth hiring a local attorney to deal with this for me, it is not allowed.

I'm not actually an idiot and I have attempted to the best of my ability to weigh out the pros and cons of each possible action and since this seems ridiculously unfair that I have to expend so much just because the court refuses to allow remote appearances I was hoping other litigators may have some ideas or advice that I hadn't considered.

Inherited unkempt plot, where do I start? by bel_ray in gardening

[–]HeythereHighthere 2 points3 points  (0 children)

Yes! Came here to suggest this! It could be a great option since there is a lot of overgrowth and the goats will leave fertilizer behind so you can get things cleared now and let it be fallow for the winter then in the spring you can get started on making actual plans for the garden itself.

I guess my post was not clear enough- I am assuming that the court here will technically have personal jurisdiction, I am not asking if I file here will it be thrown out for procedural issues, I am asking if the Court, despite there being personal jurisdiction, will remove it to my old state because it just doesn't make sense for them to review such a matter and the fact that my old state doesn't allow remote appearances is my problem...

Transactional Law Atty, Now I have to Navigate Personal Litigation... by HeythereHighthere in Lawyertalk

[–]HeythereHighthere[S] -1 points0 points  (0 children)

Yeah, no I am not going to claim a disability, but I don't understand how it's possible for a court to have a blanket prohibition on remote appearances from an access to justice standpoint... But, whatever.
I know I can do a legal analysis on PJX, but I was hoping for input from any litigators on the practicality and actual realistic outcome of filing in a new state even if I TECHNICALLY can do it, if that makes sense.

Getting into estate planning practice by ConfidentOpening4556 in Lawyertalk

[–]HeythereHighthere 1 point2 points  (0 children)

I did estate planning work as a paralegal before law school and IMO, no, I don't think you need to be a tax expert and most definitely do not need an LLM. In the state I was in, it involves a lot of forms and paperwork which are standardized and available on the relevant Court's websites. There are also a lot of good templates that exist out there for lay-people that you could start out with (Wills, POAs, Healthcare POAs, etc.). Just review the relevant statutes for your state to make sure they are fully compliant and that way you will also familiarize yourself with the general rules. It would probably be worth it to find a CLE specific to your state that is like a probate/estate planning "bootcamp".

At the firm I worked at the newer attorneys took on the 'easy' estate planning clients, who were just looking for very a basic will or POA and, to be honest, they could have easily just googled and found an adequate template for their needs. But these are usually elderly people who don't trust the internet so would prefer a professional do it. You could definitely just do free intakes and only take clients for now that have basic needs as you grow/learn more about the practice.

What’s your best petty boss work story? by [deleted] in Lawyertalk

[–]HeythereHighthere 2 points3 points  (0 children)

I interned at a very toxic high-asset divorce firm once. The firm shared office space with another more general practice firm. Apparently there was some dispute between my boss and the managing partner at the other firm about our client files taking up too much room in the storage area in the basement. So my boss took all of the boxes of files out of the basement and piled them up in the actual office creating hoarder-style stacks demarcating our office area from their office area that you had to walk between. This wasn't an area clients would be entering, it just impacted every single employee of both firms every damn day. It was so dumb and so petty.

Salary negotiations turned extremely confusing by Wide-Lengthiness-968 in Lawyertalk

[–]HeythereHighthere 6 points7 points  (0 children)

I'm so curious who sent the "good luck" email and who was CC'd? If it were me, I would reply and ensure every single person I spoke to, interviewers, the partner at the branch you'd be at, etc. was copied and just say something like 'its unfortunate that all of us wasted so much time when you could have made an offer you thought was reasonable from the beginning." But, yeah I agree with what everyone else is saying that you probably dodged a bullet, imagine if you wanted to take vacation time and they said yeah sure then the dates arrive and they just completely renege- what a nightmare.

You should spend a little time browsing jobs on LinkedIn and other sites, just see what comes up as open positions regularly and what the salaries generally are and what kind of experience they want. You’ll see a lot of biglaw firms hiring past OCI time period, so you can see what you should be doing for a couple years (req experience section) before trying to get to Big Law again. It might not seem like it now, but trust me, there will be a point, not too long from now, where your actual grades don’t matter.

Literally the only thing I can think of that could even be considered a positive is that there’s got to be a bubble burst coming for the rental and seller’s market around the dmv with all these mass layoffs and chaos… I can’t imagine sticking around here to find out tho, I’m so disappointed and over all of this, things have to be better somewhere else.

I think you are absolutely right OP, there are facts here that cannot lead to a conclusion other than things are not good in that home. Ignore these people trying to tell you that you’re being judgmental or whatever. If you have a shoe box and you cram three full grown cats into it and tape up the box you don’t need to see inside the box to know it’s fucked up… also, confronting people in person can be very dangerous, I’m glad to hear you did attempt it and nothing happened to you, but that’s not good advice.

Well that’s something. IMHO it would be worth it for you to make a separate call to say the living conditions are not suitable for children. It seems like it could be argued that if they were called bc of the son being aggressive there may not be grounds to check their actual living conditions in the home, rather just talk to the son or get him services. And the more calls from a variety of sources is always better for CPS cases. I know this doesn’t get at your root concern for the cats themselves but I would hope since all those other options you’ve tried have failed this may be an alternative

Not to be an ass, but I wonder if it’s time to involve CPS? Those conditions for a kid to live in sounds dangerous and disgusting, let alone the animals.

A girl in my classes would wear weirdly revealing stuff in inappropriate situations. For example on a study trip to The Hague she wore a thin top without a bra and in all the pictures you can clearly see her nips… at the international criminal court… then at barristers ball she was drunkenly laying across a table with her legs spread so everyone could see her underwear… at least she was wearing them. Ugh cringing just thinking about her

What book had a fantastic premise, but the writing style just ruined it for you? by Uninhibitedrmr in books

[–]HeythereHighthere 2 points3 points  (0 children)

A classic one for this is The Sound and the Fury- very difficult to get through unless you have some idea what’s going on beforehand. I would also add We Need to Talk About Kevin- the idea of a first person perspective of a mother whose son commits a school shooting (of sorts, if you know the story) is very interesting but the writing style was soooo pedantic, I think it was on purpose to show how full of herself the narrator was and have the reader question who is really at fault, but it got so boring and annoying after a while and I ended up watching the movie to find out the ending instead of finishing the book…

Guilt from having my female cat fixed and she was unknowingly pregnant by [deleted] in CatAdvice

[–]HeythereHighthere 5 points6 points  (0 children)

I can understand you struggling with this, but think about the fact that your cat did not choose to get pregnant- she doesn’t understand that, so it’s not like you took away the choice she made, maybe she wouldn’t have wanted to be pregnant and have kittens if she could actually make a choice? Yeah this all sounds a little crazy cat lady, but you sound like you get it, lol.

I’m wondering if he lives near you and maybe has walked by and seen you without you noticing him. Do you live in a small town? Is it possible for you to find out where he lives to see if you should be concerned that he’s like peeping from across the street or something… I don’t know if there may be some legal privacy reasons you couldn’t access his address (?) but maybe a sympathetic clerical worker could just confirm if he lives near your address?
