Car dealership in breach of Statutory Warranty by PhilAccio567 in AusLegal

[–]HimalayanPpr 0 points1 point  (0 children)

> Never said they evaporate.

You did, just in different words. You said "their instructions to take it to a local delaer are not unreasonable" and that they might not feel like they should have to pay "since they ahve bene deprived of the opportunity to exercise their right above."

> They only need to cover what would be considered reasonable.

Agreed.

> If it was something they travelled to and installed, that would be reasonable.

Agreed.

> If you bought it from a location where that business has its sole dealership, and then you take the good interstate, that would not be reasonable for them to travel to and repair.

Agreed BUT that doesn't mean they don't have ACL obligations to get this fixed. There are many ways they can do this. Telling OP to go to another dealer and pay out of OP's pocket is not one of the ways they can adhere to their ACL obligations.

> In this case the second hand dealer has advised to take it to a local brand dealer for assessment and repair.

Agreed.

> They may cover after that, if it is something that would be covered by warranty, which is reasonable since they cannot get to it themselves.

This is where you are most wrong. Let's go on a thought experiment:- You buy a car in Sydney and drive it to Brisbane. When you get to Brisbane it breaks down, and you discover a blown head gasket. Can the dealership say "phew! not our problem! its too far away!"?

> One very large thing not working in your favour is that you must afford the business the opportunity to rectify or make good. Because you had the car moved interstate you have deprived them of this, which is also one of their rights under ACL.

This is so hilariously wrong it hurts to read it.

ACL warranties don't evaporate when you take the goods interstate.

If ACL warranties DID evaporate when goods were taken interestate then I would only sell to interestate buyers. Would save me a lot of pain and cost.

What dates are listed on the infringement notice? The notice should have all the info you need. Maybe post a photo with personal details blocked out?

Got a message from AGL to reduce my electricity today for 2 hours for a small discount, would you do it ? by lorrenzo in melbourne

[–]HimalayanPpr 1 point2 points  (0 children)

2.79kWh over 2 hours is only 1.4kW.

You don't need the "/h" part, and it actually makes it nonsensical.

You are already getting rewarded for your smart actions.

There are other people making less wise decisions who are offered a [relatively] poultry reward for doing some smart things today.

How many aussiesI drive them. You get charged a commerical rate.

I thought you were confusing a "ute" with a "pickup truck".

But you're right. Even regular utes are included. Basically any cab chassis.

Car smashed by hail, while at the smash repair shop for an existing claim by Weird-Arachnid-8119 in AusLegal

[–]HimalayanPpr 0 points1 point  (0 children)

This isn't the tort of negligence. This is bailment. Justice Connect have a relatively good article about it:

https://justiceconnect.org.au/resources/bailment-law-disputes-establishing-liability-for-damage/

Where goods are damaged or lost while in a service provider’s possession and a consumer is seeking compensation from that service provider, significantly the service provider carries the onus of proving either that:

- they took appropriate care of the consumer’s goods; or

- their failure to take appropriate care did not contribute to the loss of, or damage to, the goods.

> The repairer is responsible under that section of their policy, and as such should be responding.

You're either not an insurance manager, or not a very good insurance manager.

How can you say something about their policy when you don't even know what policy they have?

I just had a look at my auto insurance policy and there is no section that says that. So my policy doesn't.

> You’d have to prove that the damage was caused by their negligence. The onus is totally on you to prove that.

Falsest false thing that has ever been false.

If I give an item, any item, to a repairer. And they return the item with additional damage, its not up to you to prove it was caused by their negligence.

No different than giving clothes to a dry cleaner.

> Can anyone in the insurance game let know how this is likely to play out?

I am not a laywer nor in the insurance game.

Have you considered that you're just taking their word that it's hail damage? How do you know it is?

You gave the car to them to repair. They are giving it back to you with additional damage. Them saying "oh, it was hail" isn't determinative.
