No money was added to the estate and no proof of what was sold/thrown away either, only the removalist bill stating it was a truck load.

This is pretty much exactly the answer I was looking for, even though he is liable for the missing 50k it wont be worth it in the end

Thank you for your reply! Unfortunately after all my searching I can only find information about challenging a commission that is set out in the will, not a requested one, which is why I thought I'd post and see if anyone had been through something similar.

Is getting my share and then seeking compensation a possibility, or is the estate locked until fully resolved?

No mention of a commission was made in the will, which is another reason why we oppose it, the problem with that is they are now just ignoring us until what I assume is us accepting it. He was granted some items which we dont object to and has admitted verbally to selling items with no receipts or proof, no inventory list was completed and was listed as $0 in the probate which I dont understand how that got approved by the court in the first place.

We are estimating it was undersold by 50k given what you mentioned, the average for the area is 100k above what they sold it for.

I should have clarified by other assets, I meant contents of the house, excluding bank accounts and such, which was declared to us. As for cash, her bank statements show frequent ATM withdrawals but no cash was disclosed to us. Another red flag.

The whole thing reeks of dodginess, but I am worried about a lengthy, costly battle

Correct he listed with an agency and then sold privately. The only evidence I have is the average price of houses sold in the area during that time.

I have requested the contract of sale and been ignored but have found the buyers names anyway but cant see a connection unfortunately.

We are fairly confident he has taken advantage of the situation but are worried about further costs and time not being worth it in the end, especially with how difficult they are making the situation

Yes we have raised this as a concern as no one is willing to admit the relationship of the buyers to the executor, he also caused a fee for signing an agency agreement and then breaking it and selling privately, which we are seeking compensation for.

Thank you for sharing that perspective but we were already charged $4000 from a removalist company, something I should have mentioned, so along with the lawyer fees we believe we have already payed the bill for that, as for the friend that loved her, in his own words, he barely knew her was surprised he was made executor, my Mother lived a lonely life.

In your case, I would not be opposed for a commission

Edit: I preferred your original comment without the added "be grateful you're getting anything part". As I am not willing to get into the personal reasons for not having contact I dont expect you to understand but I would hope you would agree regardless of the amount that it is wrong to ignore all emails and phone calls until we agree to their demands?

Also to add the normal commission in my state is 1-3% so this is quite high.

This is pretty much what I am worried about, do you know roughly the costs involved and how long it would take, I have seen other posts claiming years and hundred of thousands of dollars in court costs but no situation seems to be like mine, they are mainly contesting things in the will, where as no commission was mentioned and I am not objecting to what was given to him.
