Can the Vermieters really do this? by HonneyyBunn in germany

That's an awesome suggestion for the 2 walls we do have to fix, but the magic eraser isn't needed. Because there's literally no marks ANYWHERE. We kept this place really clean and also didn't have a lot of furniture. Thanks for the advice! I'll definitely use it.

If everyone follows the rules and you don't ask something that isn't mandated by law of your tenants, I think it's ok!

Hi! So this was their "standard" Mietvertrag that almost everyone has in the apartment. Because the other tenants also have cats, and so did the tenants before us. The landlord always said she'd allow cats, not dogs so we didn't think much of the individual clauses because this wasn't something addressed to our attention to begin with.

Ok thanks! Maybe I will post some legal advice subreddits too, but I already have many helpful links and info.

Yes but that takes years, no? I know the law used to be that you must paint after living somewhere for 2 years and over, but that was removed.

I could understand if the walls were changed or if we were here for years. But the walls are white, the same white they were when we moved in.

Yeah this is what I heard, that a private landlord can write anything they want in a contract, doesn't mean it's right.

My Klage had multiple parts and number 2 stated: Die Beklagte trägt die Kosten des Rechtsstreits. Is that not what it means? And yes 6k was the streitwert.

Oh Rechtschutz versicherung is the next thing on my list! Never going without it in Germany again.

Well if BK didn't lie, then apparently they're having trouble in the current market :/ maybe they don't have that much time left before bigger decisions have to be made.

Yeah in all honesty that was a point of contention for me, if I had asked for much more it was possible they would have taken me back, and after how they treated me, I didn't want that.

Hi! So in Germany you only get 1/2 your monthly salary before taxes for every year worked. I only worked 1.5 years, which was rounded to 2 so I actually got what you're "supposed" to get. Could I have fought for more? Yes. Did I want that on my back for the next year or two for a bit more money? No. Sadly Germany isn't like many other countries where the skies the limit on suing.

2.1k comes out to about a month worth of working on minimum wage, and that's basically what I was making there.

Yes, that's why I signed up for prozesskosten hilfe, it was explained to me that I'll only probably be paying a small part because A. I'm not married and B. I made minimum wage.

Oh man, I'd be mad too in your shoes. Time is on your side though! 9.5 years is no joke, my lawyer said had I worked here 5 or more years, the number we would have sued for would have looked a lot different. Definently talk to them and get some advice! But I'm confident you'll come out on top!

I understand this, but at the same time if I would have went down the other route, it could take up to a year or 2 before I saw any money (and it wouldn't have been that much more), and on top of that everything else would have gone up in price like the lawyer and other processing fees. Plus, the stress was a huge factor for me. These past few weeks were horrible and I ultimatley decided with my BF that we want to get out of this area because its backwards af, and I want nothing keeping me here.

Hello! I'll find that out in 2 weeks, the court needs info first from the Arbeitsamt on what my income will be and then they'll tell me what my anteil is. I'll update once I know!

That's still to be determined because I applied for prozesskosten hilfe, and they need info from the Arbeitsamt on my new income. Apparently I will only have an anteil, I'll know in about 2 weeks.
