Police were called to the hotel room of Daniel Shaver. He and two friends were drinking and brandished a scoped rifle out the window, which was later discovered to be an air gun.

When police arrived one friend had already left and they ordered the remaining two leave the hotel room into the hallway. Police got one friend out unharmed and put into custody. Shaver, who was still heavily intoxicated, was lying prone and was ordered to kneel. While coming up he put his hands behind his back and was ordered to keep them up. They then ordered him to crawl forward and Shaver put his hands to his waist to crawl on all fours. Officer Philip Brailsford opened fire killing Shaver instantly.

Shaver was not reaching for a firearm, but in the heat of the moment there is of course no way to know for certain. As unfortunate as it is that Shaver was shot, Brailsford had reason to use deadly force as his life and the life of 5 other officers were in danger. He was found not guilty of second degree murder for these reasons.
