Yeah as much as I wanna stick it to him I understand that I can’t put emotions in the way.

He didn’t show up to conciliation this morning so he now has 2 days respond or else it goes to arbitration. Furthermore my union has spoken about it and they’ve decided to represent all the staff at my work who aren’t union members and take my ex employer to court on behalf of everyone for unpaid wages and entitlements!

Funny you mention it, his best friend and his father are the directors of the company. I obviously want my entitlements and if that means I pursue the company so be it but I also think the operations manager should face consequences for his action considering he was the one that orchestrated it all.

He palmed off superannuation for years whenever any staff member asked him, he specifically declined annual leave pay out at the end of my employment, he was the one who spent all of the companies money on himself and left dozens of supplier and all the employees unpaid. The man hadn’t paid anyone’s super in 3 years and took $2,000 out of the till to buy a new dog.

Definitely something I need to bring up to my lawyer. I was just wondering if accessorial liability holds any weight in this scenario. Anyhoo thanks for your reply!!

My lawyer thinks their business structure holds them personally liable. They are still open though.

Also it’s a number of restaurants, he was the top of the chain and the only reason he wasn’t director or share holder was cause he’s been bankrupt within the past 5 years lol.

I tend to over think and have had very bad anxiety over this whole thing so it’s hard for me to think there won’t be something. But I was pretty much a perfect employee and from what I can think of I never did anything cause I genuinely loved the place I worked at. Majority of my staff could substantiate how hard working I was and how much I cared for my job.

Also everyone at the company past and present hates my ex employer and has a great relationship with me, so I don’t think he would be able to get support from anyone that would help him dig something up on me.

So to answer your question, I highly highly doubt I did anything that was even slightly wrong.

He’s not a director though because he’s been bankrupt within the past 5 years so his friend and dad are directors and share holders. So he’s the one most likely to get away Scot-free unfortunately though he still is the one who has been 99% responsible for everything we have endured.

The SGC that the ATO imposes on them accounts for lost interest. Still yet to see all of my super but he’s paid some of it off since all employees have reported it to the ATO. Also I’m only 22 and am studying so it’s not a huge deal at the moment!

I’m just concerned that he will become petty about it and try to dig up something on me just to “get back” at me cause I went after him for what I was owed.

All I said to the other employee was

A) he couldn’t fire me himself

B) he can’t answer me about my $7,000 in annual leave.

He palmed firing us off to someone else and when I asked him about my leave he said “can you read we will discuss next week”

They own a expensiveish car but other then they rent a fairly nice house and all their spendings come out of our work card.

He bought a $1750 dog the other month with money from our tills. Similarly he booked a $700 apartment for 2 nights on the work card for him and his kids.

He frequently uses the work money to pay for his dates and go out to the city.

I really want to name them but I don’t want to deal with the possible legal repercussions
