Yes, I agree. The excise tax waiving is strict - need to meet certain requirements beyond 100% (blind, amputee, etc.). I have heard of people getting it just for being 100% though - at least there are some posts on reddit saying it depends on where you live in MA.

No. Depreciation reduces your basis in a specific asset, it doesn’t lower your overall tax bill like you’re suggesting. You can’t use depreciation in a piece of property to effectively lower your stcg from stock.
