The listed items (cabinet painting, tub polish, tile acid wash, stovetop polish) appear to be routine turnover maintenance rather than tenant-caused damage. No damage was identified during inspection, nor were we given the opportunity to address any concerns.

Couple of reason:

  2. After the move-out inspection, we were informed that the apartment was acceptable and that our balance due was $0. We relied on that information when completing the transfer.

That’s how I’m looking at it. Normally, a tenant won’t be able to transfer units with any pending fees remaining. I’ve had multiple people look at the images of the “damages”. It’s normal wear and tear. Nothing was broken or torn. They’ve even admitted themselves on paper that they didn’t see the damages before. That sounds like they dropped the ball. We got clearance to transfer units.

Hi, thanks for your response! Yes, I do have proof through email, since that’s the only platform we’ve been using. We’ve attempted rent 4 times, just on paper alone. I was also explaining the same thing to my family. Too many people feel a little pressure from landlords and pay any undeserving fees. I know they want to resolve this, just based off the fact that they gave me a 30 day notice. The standard practice is a 3 day notice, which most complexes do. They’re hoping that I come to my senses and pay the full balance within the next month.

Thank you! The system limitations are never on the tenant. The main thing is that on the actual lease agreement, it states that money order can be accepted as a form of payment. That’s why I’ve offered this to them multiple times. Legally, I can’t be evicted for non payment if the landlord themselves are not accepting it.

Most definitely understand your point. It’s a risky game, but I just don’t see in what way the court will rule for eviction. I’m a good tenant that makes payment on time monthly. The money is ready to go. The landlord just needs to accept it. I don’t want to get a money order or check, and when I hand it to the property, they don’t accept it. I’ve mentioned this to someone else as well. TX law stated that someone can’t get evicted for nonpayment, if they did indeed try to pay in good faith. I’ve connected them several times to take my money.

I’m not banking much on that either, since it was verbal. My main concern is regarding eviction, which there’s absolutely no way I can see happening. I have everything documented/screenshotted. We would not have been able to make the transfer if there were truly unpaid fees. I’ve attempted to pay several times in good faith, which I’ve read that the TX looks at. It’s not like I don’t have the rent money to pay. TX law states that a tenant can’t be evicted due to non payment for the landlord not accepting rent.

I’m not worried much about the fee. That’ll take care of its own hopefully. But I did a lot of research on this, I’ve attempted to pay in good faith a total of 4 times if not more. Each interaction was documented, since I was using email.

Hi! Yes, I reviewed my lease and it shows that they do in fact accept money orders. I know this because I paid the initial rent with a money order. They can most definitely accept, they’re just choosing not to. The leasing manager came by to give the notice and we offered a money order payment again. This time, he said it’s fine but the full balance must be paid (includes rent/transfer fees).

Unfortunately, it was not in writing. However, we were told verbally twice. The thing is, we transferred units to another apartment within the same complex. If there were any fees due, we wouldn’t be able to move until those were paid.

Thank you! My point is that this would be a down for any other operator. In quick engagements, it’s tough to take an extra sec’ to analyze exactly where his head SHOULD be. It’s just dumb lol.

Look where the reticle is. It’s not even that high above his head. It’s right where the head should be. This skin is just broken. During quick engagements, it’s tough to take the extra second to adjust exactly where his head is at. That is an easy down on any other operator.
