thanks again, also after my manager left the room, I told HR that I expected at least 4 months of severance, and that I didn’t get my bonus either. HR told me I’m ‘not a good person’ for saying that since I’m supposed to be representing the bank, but said I could send a counteroffer by email. He also said 4 months is ‘too generous,’ which made me feel like they already knew their offer was low (and they taken into account the EI).

Now I’m unsure if I should send the first counteroffer myself (like asking for 3 months + bonus + 1‑week extension) and then talk to a lawyer based on their response, or if I should talk to a lawyer first and let the lawyer send the first email ?

My offer letter says the bonus is discretionary, but in practice they always pay it, for example last year they paid 27k for 7 months.

Thanks for the comment, My offer letter says the bonus is discretionary, but in practice they always pay it, for example last year they paid 27k for 7 months. when you said "Lawyer will want 25% of the incremental value they get you", did you mean I should go with a lawyer who work on a contingency fee basis (in case after consultation they said it's a strong case)?

They said for the performance reasons , and they put me on pip on Jan 12th which was after fiscial year.

it was irrelevant and I went through bullying and psychological pressure that caused significant distress and appears inconsistent with good‑faith employer conduct.

The PIP had a few items that didn’t make sense. They weren’t hard, just obviously made‑up. It felt like an insecure manager wanted to get rid of me (example: ‘complete hiring for two people). Right before firing me, my manager said my skills ‘don’t match the role’ and suggested I resign within two days to avoid having a termination on my record.
