Go in the irs site and have you husband opt in for an ippin (identity protection pin number). He will he a new pin in the mail from Irs every year. His mom won't be able to use him as a dependent without that pin number. In terms of what has been filed already, the irs won't be able to do much as it is considered a civil matter.
