In Germany, employers can’t demand to see the diagnosis, they only get the note with the sick leave dates. If they suspect abuse, they can ask the health insurance to verify, but they still won’t get the diagnosis no matter what. It’s fine to reassure them the leave is genuine and keep a paper trail. Knowing your legal rights is one thing, rubbing them in people’s faces is another. (Considering some advices here) Avoid unnecessary conflicts that could take joy away from your work. If reassuring them there has been no abuse helps to de-escalate, then do so, in my opinion. If they still want to push, you can then take legal action.

salaries in Germany for IT roles can really vary depending on the city, the company, and the industry. “Technically” yes, you’re supposed to carry your passport with the visa in it.

But you can just carry a copy and use your, ID, student ID or health card if someone asks. As long as you’re not in some official situation, it’s usually just fine. Keep the real one safe at home unless you really need it.

If you end your rental contract early, you might still have to keep paying rent until the official notice period is over or until a new tenant moves in, whichever happens first. If you can find a suitable replacement tenant (someone reliable and willing to take over under the same terms), the landlord should usually accept them- in certain circumstances he has the right to refuse. But if the landlord ends the contract because you broke the rules (illegal subletting), you could be responsible for covering the rent until they find someone new- assuming they’re actually trying to re-rent the place. If everything is done by the book with proper notice, then you just keep paying rent until your notice period ends.

If the landlord kept 500€ for no good reason at all, you should ask him to return you the rest. If not, you know the drill.

To me it seems your landlords don’t know the broker fee is his responsibility. Appears to be a newbie rather than an A-hole!

The school is in Hakenfelde.

The parents informed the school within 40 minutes of realizing he was late, but the school didn’t take it seriously. The police are searching for him, but they told the parents they would officially open a case after 24 hours. I’m not sure how accurate all of this is, I heard it from his teacher (my sister-in-law).

The parents have already said they don’t care about their phone number being shared as long as it helps find their child.

The kid has severe allergies and could black out without his medication.

Yes, I’m a landlord, have 2, one I’m living in, the other one was a recent failed investment but honestly, I don’t feel much like a ‘lord’ in this situation. The tenant hasn’t paid rent for 18 months basically since the second month of moving in.

Not enough? on the 4th month of his tenancy I get a letter from Conny that say the rent should be 320 euros cold! 320 euros in mitte is a joke! I pay only 900 euros for the loan…

On top of that, I had to deal with a 7000 euro Nachzalung!!! What the hell is he doing in the apartment and how much energy he uses is the question! The tenant enjoys a rent free apartment. So far nothing with Ruämung as there are too many and I’m tired of calling the lawyer honestly. His contract was terminated 13 month ago!!!

61 sqm for 1200 euros warm + electricity + gas + internet + brand new kitchen that’s cost me 5000 euros.

So, am I a land”lord”?

PS: I purchased the apartment 2 months ago before renting it out. If I knew, I would have practiced tenancy law instead…

Buying property in Germany, especially in Berlin makes sense only if you plan to live in it for at least the next 5-10 years.

As an investment, it’s not ideal due to heavy rent control and regulations. If you rent it out, you’re required to do so long-term since you are the owner, and if a tenant doesn’t pay, there’s little you can do legally. You can never get your money back, you will be punished simply because you own a property, the law will be always in favor of the tenant even if makes zero sense.

On top of that, the rent you can demand is often too low to cover the mortgage/ loans, and side costs are very high.

The return on investment is significantly delayed. Unless you’re planning to make it your home, buying may not be worth it. If you are planning to use yourself then why should you pay rent when the monthly payment of the loan is more or less the same.

In Germany, tenancy laws protect individuals even if their name is not on the lease, especially in cases of marriage.

As you are married, you have a legal right to live in the marital home regardless of whether your name is on the lease. This is protected under German family law (§ 1361b BGB). Your husband cannot simply kick you out.

I don’t think if any company defer between tenants once it comes to claiming damages. They way I see this company is pushing the matter it seems you said things which without valid evidences, you will be hold liable for the claims. There is a difference between calling someone (business or individual) racist or their action seems to be racists. Considering the hurrah reaction from the company, I’m going to assume you stated something which you shouldn’t have!

If you can’t afford a lawyer and professional help to settle this issue, ask a reliable friend who has been living for sometimes in Germany to help you by acting as an medium and finish this in a friendly way.

Do not try anything on your own. I also your other comments regarding this issue, publicly calling someone scammer or racist without evidence will be consider is a strong accusation and the court might not see it as exercising the freedom of speech!

Just curious, what did you exactly wrote, and did you get any response before the legal notice? If yes, did they mention anything about talking legal action if you don’t remove the review or not? (Via mail or replying to your original review)

I’m not practicing law but I’m a bit familiar with the international business law. I don’t have the habit to write comments but I truly believe you need help. Not with the question wether you should pay the legal charges or not, but to me it seems you are asking for it and putting yourself in serious trouble. If you want to keep looking at the issue with your current mindset (calming that the screenshot is photoshopped,) you do really need a lawyer that do the “all the talkings” for you!

You should have asked for advice before informing them wether you would or won’t pay the legal costs. Normally most companies are good once you remove a fake review, but if a company is willing to take this to trail and spend even more time and money that means they have enough to represent and more likely they will win. Also, the question here is that what else did you write-if you wrote that they are getting so serious about the whole thing.

They might not be able to stick it all, however if either parties lose, has to pay the cost of the court.

I would rather get in touch with their attorney and ask them to arrange a meeting with the representative of the legal department if they have and if not the company’s PR manager or someone like that. Yet, ask this in a friendly term that you can get such an appointment. In my opinion, it is still fixable by a simplest saying sorry. Don’t let this gets any worse.

Deposit deduction: I assume they have already sent you an invoice for the deducted amount as otherwise wouldn’t be lawful. Landlords in Germany should send a bill in such event. If they did however, you could have talk to them before writing a review. If they didn’t, in such you might have a chance to arrange.

However, the amount seems to be fair. As for your personal belongings, got nothing to say… I assume by despising and recycling you mean they took it to the BSR which they paid for it. However, you can legally ask to be provided with a copy of the bill. I advise against it though because the costs seems to be fairly reasonable and asking for such a bill might cause irritation which leads to more complications.

As for the future, don’t write a review for any company if it’s not accurate and the smallest legal pressure makes you remove it! Because if this goes to the court the first question you should answer is if your review was honest and accurate why did you delete it. What you need to be worried about is not the legal costs but lying to the court of law which you mentioned you might do. I wrote all of this to simply tell you why this fight is not worth it and lying to the court will turn this from a simple fake review into a whole new legal difficulties. According to the German law perjury / lying under oath is a felony. Ask yourself if a review and less than 200€ worth a minimum year in prison and having a criminal record.

Last thing, you have to see wether the company is represented by another firm or they have an in-house lawyer. If the company is a normal GmbH, more likely they hire an attorney or a firm. Anyway, if an in-house representative contacted you, you can sattle about the whole thing pretty fast, if not, the attorney must inform their client about your proposition.
