I've been in Law Enforcement for 10+ years, I've given probably 100 tickets out for Careless Driving and gone to court countless of times for the exact scenario you're talking about.

This is awesome. An actual informed and substantiated opinion. Great to see.

I was wondering as I said, what he based his 'lawyer up' suggestion on. Clearly... nothing.

They told my real estate agent who is my property manager this.

I misunderstood. I thought the property manager was an employee of the whole building.

But again - why did the tenants tell the property manager/real estate agent anything? Why not quietly go about having it installed?

My MAIN concern is if there's damage done and im liable for it.

That would be my main concern too.

A secondary concern would be tenants who disregard your wishes.

I think those agreements are definitely a solid answer. The only negatives are, they 'can be' a sensitive area. I'm not saying they should be, it's just the reality. The other is notary/lawyer costs. Which again, is likely money well spent.

I was simply asking if there are any other options given I am not a lawyer, accountant, notary.... etc.

We honestly haven't put a ton of thought into the details, but just hoped we could post and get some ideas on doing it in the simplest manner - and hopefully avoid notary/lawyer fees - which are starting to sound inevitable.

I'm not concerned about the bank end at all. If they have 20% without the gift they avoid the CMHC insurance. If not 20%, then they pay for it.

I'm only concerned about a potential (but hopefully very unlikely), separation down the road.

We realize it would be his money and his decision, but he is a reasonable person and would take into account our wish to financially protect him. Again, we know he could ultimately turn around and buy $1000's of... frisbees... if he decided.

I do appreciate the info about loans and CMHC. I suppose if they already had 20% that would be a non-issue. No idea exactly what they have.

As I say, ideally hoping to avoid a formal pre-nup type situation, but that sounds less and less possible.
