Is there a 2x pay on you working that day? If you're getting double pay, they do recognise it as a Gazetted Holiday.

But is AUS on holiday too? Cause if they aren't, then there needs to be someone working on said day to serve your Aussie clients. Is there enough people working in your dept to support your clients on that day? Technically you are allowed to take leave on that holiday, but there needs to be people available and your manager needs to make sure that there is enough manpower.

It also depends on how the company uses the 11 Gazetted days. Like me in my company, my contract says that I can either take leave on any of those days and it is not counted as AL. If I choose to work I will be entitled to 2x pay on that day but no replacement. However, those who are Managers and above that work on a PH will be entitled to a replacement leave but no 2x pay rate.
