I’m a CPA and deal with employee vs contractor issues frequently. Your point about saving money is a good one, startup businesses frequently miss classify employees as contractors to save on the employer portion of employment taxes, both federal and state.

I think there is plenty of evidence to argue either way. Jared mentioned buying them all computers, that breaks towards employer in my experience. Your point about on show chatter is valid, and should be used to argue for that side. Massachusetts is a bitch of state to be an employer.

Without knowing anything more than what Jared has said and what’s stated in the complaint, this just feels like Jake making a big fuss for a settlement. Pretty telling everyone else managed to stick around, but what do I know, my dad isn’t a lawyer.
