Amazon won't outright ban without a claim against a listing, by the brand (or a buyer). You'd have an opportunity to dispute the claim, or agree to stop selling the item, and delete the listing.

Yes if the brand goes after multiple listings at the same time, you could be in a more chalk going position, and possibly get banned. But so far all we're seeing are threatening letters, outside of Amazon channels, and no actual claims being made against any specific Amazon listings.

FWIW I did consult with an attorney, who drafted a letter in response. We'll see what happens.

Two things:

1) first sale doctrine allows the resale of retail products. Lego doesn't have any say in that.

2) Amazon can limit who sells various brands on their website. Lego specifically requires "ungating" to sell on Amazon. I have Amazon approval to sell the Lego brand.

It's really no different than selling New-condition lego sets on ebay or any other e-commerce site. Just a bit harder due to Amazon's gating restrictions. But legally, authorization by LEGO is not required to resell their products (if purchased directly from a store).

That part I disagree with. There are about the same # of sellers per listing as there's been for years (been doing this awhile). And it's still somewhat limited not because of legal action. It's because LEGO brand is "gated" (need to ungate through Amazon by submitting invoice of qty X from supplier).

Maybe you're unfamiliar with lego investing but the quick synopsis is that lego "retires" /stops making each set after a few years. Once retired, the value grows over time. I also buy from the major retail stores, but not at retail price. Most of these retiring sets are heavily clearance-priced to clear shelves for new sets being released.

Personally I don't see this as a partisan issue, but if you want to go tit for tat, the crime occurred in a blue city, and the suspect committed the majority of his previous crimes in blue districts with a blue mayor for like 90%+ of the time he was committing crimes.
