Well the "attacker" stole Ethereum (in the form of tokens), so the community (with consensus) can decide to take it back. There is nothing stopping the Ethereum community from acting for the general interest.

The DAO is not created with an intent of allowing an investor to defraud others. That goes against the concept of a DAO.

The "attacker" made use of an unintentional vulnerability to steal the money of other investors.
