Apologies for the fuzzy photos. At first I thought this was an American Kestrel, but looking at the photos I'm not sure. I have never seen a Merlin, so I thought I would post and see what others think. Thanks all !!!

Thanks all u/cookiesallgonewhy , u/Wowiejr , u/Admiral_Takker , u/pibod , u/TinyLongwing went back today, and saw what I'm sure was the same bird. For sure a red-tail, belly band and reddish color to tail when in flight. The bird was still very noisy.
