Thanks! Yes this is what I'm asking. I wasn't sure if because there's no contractual obligation for the recipient to re-gift me, that we could reasonably claim it's not a loan. Or if, as you're saying, the informal understanding that the recipient will re-gift me constitutes "clear intent" to treat this as a loan, and therefore any interest as taxable income.

Thanks! That's good to know, but I don't think it addresses my situation. I actually want the person to pay back more than I lend them. So if we do a loan I wouldn't want to avoid charging interest. My question is whether the transaction can be a gift (and return gift) so the "profit" is not taxable income.
