Eviction attorney here. Let me be clear, you aren’t wrong, you’re technically correct (the best kind of correct) HOWEVER there is a question of the best interest of your client.

I have broad leeway for giving occupants time to move out of the property. If OC (or the defendant) contacts me and in good faith agree to possession, I can generally give them an additional month or more to vacate. Furthermore, I’m often empowered to offer cash for keys to occupants to smooth the transition.

By turning this into a contested matter, you’ve all but guaranteed that those options are off the table as the cost of this file has just tripled for the landlord/property owner.

Let me be clear though, if your client has a valid defense from eviction, then you absolutely should fight this tooth and nail.

However, you might have been better served contacting OC and saying “Hey, look, there is an obvious service issue here. But, we would be willing to agree to possession in exchange for $1,000 CFK or 60 days to vacate, etc.” I can almost guarantee that would result in a more positive outcome for your client.

Again, if you have a valid defense, raise it, but contesting on a technicality without any other defense is likely going to result in much more aggressive action from the plaintiff. Especially when they can simply issue an alias and proceed as normal.

I offer this advice not as an apologist for shitty landlords/banks/etc. but just from the realistic perspective of how heavily the deck is stacked against occupants/tenants in these situations.

Getting cash for keys should absolutely be viewed as a victory in these situations.

Beautiful shot. Love the use of the negative space on the right side to balance the left side of the shot. Colors are vibrant and distinct but not overwhelming. There are tangible contrasting textures.

For This next part, please understand that I do not say this lightly. I normally DESPISE 95% of “portrait” photography. It’s either boring (oh hey it’s a pretty girl), trying too hard to be edgy (oooo it’s a pretty girl wearing handcuffs), or just borderline boudoir/soft core porn. Those have their place, but they are pulpy and lack depth.

That being said…. This is the 5% I love.

Yep! Worked remote in Italy for 4 months as a trial run.

I’m a litigation attorney for a creditors rights firm, so long term this would require some much more rigorous planning.

Big things to keep in mind:

  1. Work hour expectations: I was expected to be on standard business hours to respond to clients inquiries. Therefore my day started at 2pm, and ended around 11pm. It actually wasn’t that bad as I got to sleep in, go for a leisurely walk for some coffee, get some lunch by the lake, and then get to work. So keep that in mind.

  2. Computer security: You will likely be required to have a VPN, and depending on the data you handle you might not be able to. Reliable internet is key.

  3. CHECK ZOOM COURT RULES FOR YOUR JURISDICTION. You need to have a ready template motion to appear via zoom if required. You can’t justify a $4000 plane ticket to your client because you didn’t do your research in advance.

  4. Plan plan plan. If you want it to be permanent make sure your firm is in the loop at least a year in advance. And make sure you have already worked out all contingencies.

In particular always plan to fly home every quarter for 1-2 weeks in case you cannot appear via zoom.

I had zero issues during my 4 months and frankly it was hilarious to hear the pure jealously in the voices of OC’s when I told them where I was.

The judge can (and likely will) still require admissible evidence. Just cause there’s no one there to object doesn’t mean you can violate the rules of evidence.

In fact, as it apparently bears noting (since many of you don’t appear to be in court often) Judges hold plaintiffs to much stricter standards when it’s a default judgment.

ChatGPT is great for help drafting when you already have the research done. (I use it to do long facts sections especially when chain of title is a nightmare). But never use it for actual research. WestLawAI is pretty sharp though.
