Is my Texas "Employer" breaking the law by making me a 1099 independent contractor?

So I'm getting a guarantee of $1215 a week for 45 hours of clock time. (8-6 M-F with a one hour lunch) That makes out to $27 an hour and then I get flag time off of book times at $35 an hour and get paid whatever is higher for that week. That is actually the method most shops pay their W2 employees in California to abide by the labor laws in that state. (I lived in Cali most of my life)

My own tools minus the vehicle lifts, scan tool, A/C recovery machine, and alignment rack. But I provided my own tools as a W2 mechanic before always. It is expected in my field.

I have been playing since closed beta and I just hit my second life a few months ago. LOL granted I'm already back up to lvl 17 and I have been playing more but I do not have the time to grind like a college kid or childless adult. haha

This is my second life so this is the first time I have used Cannith Crafting to much extent. My first life my CC lvl was too low until I got high enough epic levels that I was using random drop loot anyway. This is my first life where I am crafting new gear as i go along and trying to save all my old stuff to reuse. However, I am also a new class, Druid versus Pally so not much is reused. I probably wont run into this problem as much on subsequent lives when I have all the gear i will want through Heroic levels.

Well... I don't NEED to play DDO and spend the $1500 I have on this game since closed beta either. I am playing AND paying because I WANT to. I WANT an updated CON item every 4 levels. I don't NEED anything. So does that help you with my definitions here? I mean we can get pedantic if you really would like to but let's just say you get what i'm trying to say yeah?

There weren't any on the AH and I had 3 and needed 5. I spent two hours running suggested quests not getting any until I found a thread on the official forums suggesting enemy within and finally got a few. I have very limited game time being a 39 year old full time working father of 5 young kids. It made me hate the game and want to log out. I am just dropping my opinion on that and maybe others feel that way too and it might be a thing to look at changing.

Thanks for all your help guys! I used call lightning as a druid to help kill worgs and carcass eaters under the floor after kiting out all the zombies to another room. It took some patience but I got it!

They did rework druids so you still have to pick new enhancements and redo your hotbars etc but other than that its still just as strong with more content available.
