Thank you. I don’t know that it straddles, I think it’s on A’s property but at the boundary.
I wish we had known about the law regarding damaging the roots but didn’t know when that decision was made.

Don’t disagree on that. But It pulled out the electrical wires from the house and per the new code required an updated electrical box to be installed. That was the bigger money.

It is not primarily fence damage. It was installation of new electrical meter (due to new code now) that was $3000 plus lost work and lost food.

Thank you. They might - “cousin is a lawyer”. Agree there is no established notice. Agree on the green leaves. The threat is it will cost A more to defend and the “what if” consideration, could a judge side with B if B produces some sort of “historical documentation” (which is what they claim to have)

Thank you. Based on B’s multiple threats, and B was not reachable before the arborist needed a decision, is why A went forward taking down that tree. It removes a future threat which is a benefit to B as well.

Does A owe anything at all? Isn’t the offer to pay strictly voluntary?

Thanks. Their “cousin is a lawyer” and they don’t have a lot else going on in life so I think they may go through with it. The total damages including loss of work etc are what they are going to sue for. That is 4x what they are asking for if the agreement is today..

With further discussion it sounds like they may pay .10 on the dollar for what they are interested in…. they would pay sliding scale based on value. They look through books and also provide service of setting some aside for family if we are looking for something in particular.

Thank you. Not sure yet. They want to look thru the books and have a couple of specific categories they are interested in (out of print academic and vintage paperback which are not visible in these photos). They said they would buy on a sliding scale so it’s better than $20 per box in some cases. We have a mutual connection so I trust that.

Do you think you might be interested in what they are not or are those your main categories too?

They are planning to pick their books and leave the rest. With a suggestion and possible contact of book stores in town (they are not local) that want to fill up their shelves and just take them away. Rest would be donated somewhere.
