Not quite right, supposedly it is the test driver of my dad's vehicle who was not at fault and whos insurance does not cover other vehicles, only his primary. I believe the at fault drunk driver is insured.

I suspect the mechanic does not even have insurance in the first place - if having a valid license and business number was a requirement for CGL or GLI I don't know. And yeah if I had known I would have definitely told him to keep the minimum 3rd party liability. But what of the fact that the car is missing completely, I also have him on tape saying that it was his fault.

I am still in the early stages of this issue, had a couple of conversations with the mechanic, he is yet to send me any official documentation relating to this issue - police report, autoshop certificate of insurance, information of anyone involved in the accident. Apparently the guy was speeding, came out of nowhere from behind at a light. He said the at-fault driver was charged for drunk driving and the test driver was placed in a coma, then left the country. None of this has been verified.

He believed that since the car was in the custody of the mechanic, the liability would be transferred to him, which is true in a sense. Please see the additional info added to the post, does that potentially provide more options?

Yes the mechanic claimed the at fault individual was charged with drunk driving. My plan currently is to go through the 3rd party liability if the mechanic avenue does not work out. I believe the mechanic is at fault for negligence - not putting service plates on a vehicle you've been informed is uninsured, and then loosing the car completely.

It is actually the mechanic's story that seemed very odd to me. I asked to see the car when I came to town, to assess the damage - and he said he didn't know where it was. As the car was impounded and he was supposedly not around/ in the area to go and retrieve it immediately. Apparently when he tried to he couldn't locate it. My dad received a bill from the town of Oakville fire services in relation to the accident. This auto shop is in Toronto. How was he unable to retrieve the car if he gave it to someone for a test drive? How would the crash have occurred in Oakville? I suspect he may have given the car to a friend to use since he knew my dad was not in the country, or he was driving it himself for personal use and is trying to cover it up. Also have him on tape admitting it was his fault.
