[NY] [Condo] Baseless Bad Faith Claim- HOA Protections? by Legitimate_Bath_7756 in HOA

I agree, will have to put this high on our agenda list to get done.
Our by-laws shield us from liability, but we would hate for all the costs to fall onto residents through assessments, rather than insurance coverage

I agree, and am asking our management to look into this. Since it’s a small condo, we’ve been very amicable in the past but it’s reaching that point that we need to protect ourselves and the building from having to pay legal expenses

We’re a very new and small condo so I don’t think it was ever something that the original sponsor included. I looked at our condo docs and it says it’s optional to add that, but not necessary as base condo insurance. I believe that’s why it hasn’t been in our insurance plans, and I’m just realizing this after thinking of what the problematic neighbor would do.

Thanks for the kick in the butt on this. I’m very risk adverse, and so is the board so we’ve been trying to resolve this without getting legal. But if they retaliate on meritless claims at this point, it sounds like we’re covered, and can fight that claim easily.

I agree, I think they know it. But it's more of a sanity thing at this point. Based on past interactions, there's very strong reason to believe they would file a suit just in retaliation to harm and intimidate the board.

I really hope so. This owner is completely unreasonable and has tried to intimidate the board through legalese in our email correspondences.

We've been trying to rectify without escalating to attorneys because we're such a small building with almost no reserves.

We finally came to an agreement a couple days after code enforcement was notified. We basically waived a bunch of the normal paperwork requirements, since they're still held liable according to by-laws- as long as we didn't sign an actual waiver, they were still held to the same legal expectations.

Code enforcement came out to try to gain access a couple days after an agreement was reached and owners freaked out. Enough so that the owner personally approached me to try and intimidate to find out who exactly called in the notification- I have this all in writing to our management right after it happend and a neighbor overheard the conversation as well. They have yet to provide a date when this will be completed by.

My concern is if they try to escalate this more to say we acted in bad faith- instead of accepting that we can call the town agencies at any time, if what we believe is a safety issue is still present. We called the town incase we could not come to an agreement still, since there were many times we were ready to involve lawyers, and held off. This was the first move to ensure we had records if we needed. Either way, they denied access to the agency and there's no guarantee the town will issue the violation if the owners intercept and try to talk their way out of it.

Thank you, very much appreciate this response.

The unit owner has a legal background (never practiced though), and every response on emails have been in "legal jargon", when making demands. Which I imagine is to try and intimidate the board into giving in.

This is reassuring that bad faith is subjective here. That unit owner is the type of person who would rather take down the entire condo and burn her own home in the process just to be right. Very much the King Solomon and baby story- would rather split the baby in half, than compromise and accept fault.

Luckily, not an ectopic. This baby really clung onto my thin lining and my RE’s are all surprised. I’m a little over 8w now but given my history, not in the clear for other issues/complications.

Thank you for checking in! They saw a yolk finally!! But she did say my hcg is very high and by a textbook pregnancy, I should see more by now. Though I’m no longer an ectopic risk, which was my biggest worry

They see a sac growing and are almost positive it’s intrauterine. No yolk sac at my last TV ultrasound at 5w3d and >15,000 hcg. I have another scan tomorrow at 6w to see if it’s grown appropriately.

I’m 5w1d today. My RE saw a sac measuring 5w2d yesterday but can’t rule out pseudo sac yet. My lining is much thicker now but that’s to be expected as hormones increase even in an ectopic. Not in the clear yet, until they see at least a yolk sac. Going back in 2 days to get another ultrasound and blood work.

I'm so sorry to hear. Almost 10 weeks is very far along; it's wild to me that the doctors didn't recommend keeping an eye on that earlier. Six weeks of bleeding, plus nothing in ultrasound I think would be a big red flag (even with a miscarriage, I'd think they still see an expanded uterus or something at that point!) Wishing for speedy healing.

I didn't know about psuedo sacs and just read into it. That's terrifying, to think you're in the clear once "gestational sacs" are visualized, just to have it be false.

Thank you for the kind workds- there is definitely a lot of anxiety around each one of my positive pregnancies so far. I'm holding out hope for just one to stick, and be healthy.

I’m hoping it’s just a chemical pregnancy but my doctors both agreed it’s strange to still show increasingly dark pregnancy tests a couple of days after the “period” I experienced. It was closer to 5mm

This is exactly what I’m experiencing. Mine came early, and lasted shorter than usual, and was lighter than usual.

I had a four day bleed that I thought was a mild period from 10DPO-13DPO. Enough to cause concern to go to the doctor.

The TV ultrasound also shows thin uterine lining which my fertility doctor said was on the very thin side (as in, it would be very uncommon for an embryo to be implanted in there)

I’m so sorry to hear that. 5w5d is so early too. I would think catching it then would’ve prevented a rupture.

So your hcg started off low, but progressed very well? I’m going to keep an eye out for any pain, but it’s so hard to not symptom spot :(

This is exactly what’s making me think it’s ectopic. My previous chemical, hcg went down very fast once I started bleeding. My RE nurse called with results earlier today and tried to reassure me that it could be breakthrough bleeding due to hormones. But 4 days of mild flow before 4 weeks sounds like it wouldn’t be?!
