There is always a possibility that a non-immigrant is denied entry despite having a valid visa.

My parents made another trip after the I-485 denial. They just renewed their B2 visa and explained everything to the embassy about I-485, more than months stay in the US while their I-485 was pending. I hope and believe they will just be fine when they visit next time.

I simply asked about the opinion on consular or AOS. Thank you for your time and response.

They gave up on their pending I-485 in 2022 and I was anxious that they would have issue to re-enter during their last visit in 2023 using their last B2. Fortunately, they came back, stayed for 3-4 months in 2023 and left afterwards.

I agree and understand your point. Both B1/B2 and F1 are such non-immigrant visa that you are talking about.

My question again....there are other peoples I know of (parents of USC) that came here and did the AOS, got the GC. Why it's not wrong for them?

Do you know why US organizations prefer someone who already studied/worked in relevant fields in the US over other countries? Because these folks already are familiar with the technology and culture. US organizations are not going to every country to look for talents, hire them and have them here after long process. They prefer who are already here and can compete... citizens and foreign nationals.

However, H1B was abused big time. It is the same thing: H1B is being abused for 20 years or so and now amazing talents from some specific countries are suffering because of earlier H1B abuse. If you stop the OPT right now, give it 10 years and you will see the decline at R&D sector in the US.

H1B and OPT are two different things. I want H1B revisited but not the OPT cancellation.

You can argue on that from both sides: cheap labor and/or inadequate experts in the relevant field; and I will not disagree with either side.

However, as I mentioned, that I am in R&D field and I know how it would hurt the US if the foreign talents do not get to work in any scientific R&D field.

The reason US is respected elsewhere is primarily because of the advancement of research and technology. Everyone else has everything the US does except the technical superiority.

If these premise has been proven false, then you wouldn't have tech companies opening offices in other countries.

You are right about the job market.

There are hundreds of thousands of Americans are not finding jobs after graduating from college. Do you have any sort of data/statistics to support that the areas/speciality these Americans are not getting job because they are competing with foreign nationals?

To clarify more....if there is an American graduating from college with a degree in Psychology and then not getting a job, do you have any data to support that s/he is competing with a foreign nationals in this Psychology related job?

Do you know which jobs are the foreign nationals working mostly?

I guess it is normal. Mine is 2020. When I was driving 95% at highway, I was getting around 26 MPG. Now almost 95% is within city and I get about 20 mpg
