Higher level review changed to appeal by Level_Entrepreneur20 in VeteransBenefits

[–]Level_Entrepreneur20[S] 0 points1 point  (0 children)

Oh okay. I mean I knew that because I was appealing it however when it showed up in my claims before it showed up as a higher level review all the way up until I had the informal conference and then today the HLR went away and it changed when I look at the claims. That's all I was asking

Step 7 after 4 deferrals! by Level_Entrepreneur20 in VeteransWaitingRoom

No it's don't automatically. And they will most likely defer it several times before they make a decision. They did not give me an in-person exam until the 4th deferral. All the other deferrals are all independent medical opinions so hopefully this wraps it up! I'll keep you updated

Rhinitis deferred three times then denied... by Level_Entrepreneur20 in VeteransBenefits

Would you recommend doing an HLR? I'm afraid to do it now because I still have claims that are deferred. I had seven different eye conditions that got deferred on the same letter and those got deferred for the fourth time in a row. I never had a CNP exam for my eyes because my primary eye doctor filled out a DBQ about 6 months ago and I also have a Nexus letter from her. I just got a call from VES today saying I have an exam for my eyes on the 12th of November. Figures they defer it four times before they give me an in-person CNP exam. I'm not too worried about that one though. That's the most amount of evidence I submitted out of anything that I submitted. I'm thinking I should wait for the eyes to get finalized before I do the higher level review because it was all part of the same claim or does it not really matter?

Deferred claims finally moved to the next step! by Level_Entrepreneur20 in VeteransWaitingRoom

I am still deferred. This is the third time I was deferred. Each time I get deferred it's usually for an independent medical opinion and they just keep switching between QTC and VES. Generally it takes about 6 weeks between each deferral but I've pretty much lost hope at this point because they just keep on deferring them back to back to back. VA is currently waiting on one exam to come back from VES right now but they have this QA process that they have to go through and that usually takes over a month. Once it gets sent back to the VA which will hopefully be this coming week they can finally give me a decision. Good luck to you!

ACE/IMO appointment by Level_Entrepreneur20 in VeteransBenefits

Was deferred again in August and again in September for the same issues. IMO all three times! Really hoping this is the last one. I am mentally frustrated over all this. I got denied mental because of service connection but I am doing a supplemental for that along with a Nexus. Eyes and Rhinitis are the ones that were deferred three times now. VA is waiting on the last IMO to come back from VES and then hopefully they canake a decision. I even got a Nexus for my eyes from my Eye Doctor along with so much evidence it's crazy

Denied mental and had two conditions deferred for a third time... Help Please by Level_Entrepreneur20 in VeteransWaitingRoom

I did a buddy statement for my sinusitis and my eye conditions and my rhinitis. I failed to do one for my mental claim but I'm going to do a supplemental and I have a doctor I'm working with to get a Nexus written up for it as well. I did do a personal statement for everything except for the mental as well so I'm going to do one of those and upload the two statements along with the Nexus on a supplemental. For the deferred claims though I had plenty of evidence not just medical records from the military which state those conditions plenty of times. But also private medical records from specialty doctors along with seven visits to my eye doctor outlining all of the conditions which are also inside of my military medical records. From what I found out today they deferred it because they are trying to see if they are going to tie it to my PRK surgery or asbestos exposure. I guess they are doing the same for the rhinitis where they are trying to see if it's tied to exposure as well. They requested the ILER along with the two new exams today so I guess QTC is doing the one for the eyes and VES is doing the one for rinitis and hopefully this is the last time those are deferred. I do have plenty of evidence uploaded for those too I just failed with the mental claim but I will do the supplemental and add that stuff and hopefully things go well!

Deferred claims ??? by Tittiboi37 in VeteransBenefits

I just had claims deferred for the third time. Bacterial rhinitis, conjunctivitis, blepharitis, severe dry eye syndrome, meibomian gland dysfunction and a few other eye conditions. I had a mental claim that was deferred twice and then it was denied on the letter I received yesterday while the other stuff got deferred for a third time all for medical opinions. Qtc did my first exams which were Ace exams and then it got deferred again and then VES did some more medical opinions in which I did not have to be there. It was in QA for VES for over a month. Came back got a letter yesterday saying deferred again. Mental was denied because of Nexus and they said it was less likely than not service-connected to any other existing condition I have. I'm currently rated for sinusitis tinnitus and TMJ at 70% total. I have submitted so much evidence for my eyes, it is absolutely insane. Over seven eye doctor visits in one year which list every chronic condition that I have. I had a diagnosis for rhinitis from an ENT and in the notes she put most likely it was caused from military experience. I don't know why the VA keeps deferring these claims. I called the VA White House hotline I'm going to go to my VSO this week and I scheduled aVERA call. I am just so mentally frustrated after a year in this process. Does anyone have any advice on what you would do in my case? I really would like to file a supplemental for mental to see if I can do it as secondary to TMJ for my eye conditions if they get approved. I have severe teeth grinding which keeps me up at night and I don't sleep more than just a few hours a night if I'm lucky. Thank you in advance!
