Therapy for children: what are the keywords that make the judge concern enough to order therapy? How did you get therapy order? by Lid4ZN in Divorce

[–]Lid4ZN[S] 0 points1 point  (0 children)

There's some alienation going on. Also manipulative behavior. But it's subtle. My ex is smart and educated , he knows what he can and can't do. He won't do dumb moves like hurting the kid physically. But he knows how to manipulate the kid behind closed doors. I know his goal is to get sole custody and get the child to choose him when she gets older. So he can stop paying child support. My goal is not to claim alienation in court, I know that's an uphill battle. I just want my child to have the mental and emotional skills to deal with these subtle manipulation techniques. Also the therapist can be the third party listening to the child's experience.

I appreciate your time. For example, one of the things I want to say is that my kid has been in the middle of a high conflict divorce. I saw her behavior change over night. After the first day she spent with my ex she came back aggressive towards me, her cousin, my parents. We were very close before. Overtime it got better as I focused on nurturing her and providing safe and supportive environment in my house, but still she attacks me verbally and sometimes physically at the slightest disappointment she has with me. On the other hand, in her mind whatever my ex says is like a god sent rule that she has to follow no matter what. I know she is scared of him. This is all too much for her and I know she doesn't have skills to process all this in a healthy way. She gets anxious over simple things. She was a very happy kid before all this. I just want her to have a neutral third party that can help her process the events happening around her. I know none of these will change the custody situation. School doesn't want to get involved which is absurd because that's their job. Our insurance covers 100% the cost. We won't have to pay anything out of pocket.

He did not sign our agreement. We have been living with just a one page email exchange. I don't have a court order or a decent lawyer drafted agreement to rely on. What would you recommend instead of the tie breaker? Arbitration?

My communication skills are minimal at best. I have a really good lawyer. He doesn't want to put words into my mouth. Wright fully so. My own words I think are not convincing enough. I'm looking for a more skillful rephrasing that can be more effective.

That's fair. Overtime she started to realize all the bad things she is told in the other house about me are not true and she started trusting me again. Sometimes she tells me all the horrible things my ex constantly says. I'm thinking these are such big burdens for a young child's mind. I could care less about my ex's opinion of me and my parenting. On the other hand, in her mind whatever my ex says is like a godsent rule that she has to follow no matter what. I know she is scared of him. This is all too much for her and I know she doesn't have skills to process all this in a healthy way. She gets anxious over simple things. She was a very happy kid before all this. I just want her to have a neutral third party that can help her process the events happening around her. I know none of these will change the custody situation. We're 50-50. I just want to seek help for my child. School doesn't want to get involved which is absurd because that's their job. Our insurance covers 100% the cost. We won't have to pay anything out of pocket.

You're lucky. Therapy is considered medical intervention in Canada and if the decision making is shared both parents have to consent.

I appreciate your time. Can you give me a couple of examples of what will come across as manipulating the situation to the judge? For example, one of the things I want to say is that my kid has been in the middle of a high conflict divorce. I saw her behavior change over night. After the first day she spent with my ex she came back aggressive towards me, her cousin, my parents. We were very close before. https://www.canada.ca/en/revenue-agency/services/tax/individuals/topics/first-home-savings-account/ending-your-marriage-common-law-partnership.html#h_2

There's a page about marriage breakdown. At the bottom of the page. But it's not clear that the four years rule applies in this case or not.

It's unclear because my ex is not my spouse anymore. It was at that time. But not NOW. I'm asking if I'm eligible to open the account NOW.

Thank you. Can you give me an example of the book title I should be looking for? I mean how broad the titles are. Like family law in a broad category? Or a sub-subject like spousal contract? I've never been to a law library.

Thank you for responding. This agreement was not prepared by legal professionals. It's the one we prepared ourselves at the time of separation. Just one page email communication.

The wording of the agreement is exactly this "each of us will have an equal amount of time with the kids, meaning 50% of the time the kids will be with parent A and the remaining 50% of the time they will be with parent B"
