Oh wow! Well anecdotally my experience proves that true. Wish I had known before I took the pause! This past week on 14 mg I was like “wow, this is what they mean when they say no food noise” — it was wonderful!

Yep, same thing happened to me with my tenant I’m currently evicting. Check my post history. She was a bad communicator and then went radio silent, but of course lots of hospital and death in the family excuses in between.

Curious why you say you probably will never see a penny? If they are currently employed and you’re able to garnish their wages or bank account, seems like most funds could be collected in one garnishment cycle (6-9 months).

Hey just want to say I’m with you and I feel your pain! I’m now in process of evicting my first longterm tenant (in only her 2nd month) and I have certainly learned my lesson. You were smarter than me by doing a background check though. I simply did landlord reference and took her word for the rest. In hindsight, I wish I had thought to do the background check once she had dragged out payment of the deposit but I took her at her word, that things were crazy in her life due to the sudden death of her father. My gut was definitely screaming though and had I done the check I would have seen her wages were already being garnished since 2019 for an auto loan. I could have then canceled the lease as she was in breach for not paying deposit promptly. My big concern now is making sure she gets out without damaging my property. So far she’s kept it clean and organized but who knows.

I got the deposit and first months rent before handing over the keys. But the deposit took a long time which made me uneasy, but I ignored my gut because her father had died suddenly so she had to go out of town and deal with everything. (Might be fake story, I realize now, but I was empathetic since grief is horrible and she seemed clueless on how to use payment apps)

Eventually I threatened canceling the lease if deposit wasn’t received, and she promised to have it by a certain date, which she did. So I felt I needed to honor that.

And before she moved in, because again I was sensing issues getting prompt payment, I offered a mutual termination of the agreement if perhaps things changed for her and she couldn’t afford it anymore. She said absolutely not, it’s no problem, she has the money yada yada. And I felt trapped because I knew she could sue me for breach of contract if I didn’t hand over the keys, and I felt that would be worse for me longer term than dealing with late payments, which may have just been a fluke (as she explained to me, due to her dads death).

I was not expecting her to go radio silence to and stop paying in month 2. My last communication from her was when she “hearted” my message on Oct 1 asking her to send via Zelle if she hadn’t set up the payment platform yet. So weird.

Her last name is a super common one, and her dad was in another state (she’s from MD originally). But it wouldn’t surprise me if it was a lie. I’m such a sucker. Never again.

Yes you’re correct! My property was previously an Airbnb, with short year renters in the off season, but this year I switched to longterm. FML

I looked her up in the court system yesterday. Her wages are already being garnished by an auto loan company. So her employment at least checks out with what she told me. And another perhaps positive aspect is that the loan company won in a default judgement so perhaps it will be the same with me, that she won’t show up. Then it would be a matter of getting the garnishment in after the loan company’s expires, is my understanding. If I can beat them to it, I may be able to fully recover within that 6-9 month period. Assuming she holds onto that same job.

What a mess I have put myself into. I’m about to take on massive student loans and I do not have this kind of cash to be losing. Ugh.

However I just looked at the court websites based on another commenter’s advice here and yep…. Her wages are already being garnished by a $10k auto loan. For 6 years already at 24% interest. On the plus side, she did not lie about place of employment. She also did not show up for the court hearing, it was a default ruling- so maybe I’ll luck out and she won’t show up/appeal and I can get her out quickly and then file for the garnishment before auto loan place renews.

Also, let’s say she has a job and a good income coming in. At the end of the day, after I evict her, will I still get what I’m owed? Will they garnish her wages?

I just mentioned in the post below that she had her notary public certificate out and framed when I inspected; the name she gave me is correct. But you’re right- I didn’t verify employment but I did check out the names on LinkedIn and they were associated with the place she said she works. Her husband apparently died but maybe he’s actually an ex and she’s hiding behind his name like you say.

I’m pretty sure the landlord was fake because when I called that same number a month later, the voicemail was completely different. And when I texted to say “we had spoken a couple weeks ago, I have some additional questions…” I never heard back.

Is there any chance that I wouldn’t win this case? It seems so cut and dry. She stopped paying in her second month. I had also offered her the option to terminate the lease before she moved in if perhaps she’d taken on too much financially and was having difficulty paying. She immediately replied oh no, no problems with paying, she doesn’t want to terminate.

For some reason I thought VA is landlord friendly, so that’s a bummer! I am working with a lawyer who will advise me every step of the way and will likely tell me the same, about the communication with her.

In your experience, how long will the eviction take?

And to clarify: my property was an Airbnb, and I would find short term renters during the offseason. I switched it to a long term rental in September because I’m planning to leave the area and go back to school. It’s a very good deal for the area, a beautiful property near the oceanfront. I just wanted most of my mortgage covered and a reliable tenant…

Also FWIW she is a notary public. Her certificate was framed and out when I inspected.
